79 AN ACT
810 relating to a study on the state certification of music therapists.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. DEFINITIONS. In this Act:
1113 (1) "Advisory council" means the Advisory Council on
1214 Music Therapy.
1315 (2) "Commission" means the Health and Human Services
1416 Commission.
1517 (3) "Music therapist" means a person who has completed
1618 an approved music therapy program and holds a certification by the
1719 Certification Board for Music Therapists to practice music therapy
1820 or provide music therapy services to a client for compensation.
1921 (4) "Music therapy" means the clinical and
2022 evidence-based use of music interventions by a music therapist to
2123 accomplish individualized goals for persons who are in a
2224 therapeutic relationship with the music therapist. The use of
2325 music interventions may include music improvisation, receptive
2426 music listening, songwriting, lyric discussion, music and imagery,
2527 singing, music performance, learning through music, music combined
2628 with other arts, music-assisted relaxation, music-based patient
2729 education, electronic music technology, adapted music
2830 intervention, and movement to music. The practice of music therapy
2931 does not include the diagnosis or assessment of any physical,
3032 mental, or communication disorder.
3133 SECTION 2. ADVISORY COUNCIL ON MUSIC THERAPY. (a) The
3234 Advisory Council on Music Therapy is created to conduct a study on
3335 the need for state recognition of music therapists.
3436 (b) Subject to Subsections (c) and (d) of this section, the
3537 advisory council consists of nine members appointed by the governor
3638 as follows:
3739 (1) two members who are music therapists in this
3840 state;
3941 (2) one member who is a music therapist in this state
4042 and represents an institution of higher education, as defined by
4143 Section 61.003, Education Code, that has a music therapy program;
4244 (3) one member who is a physician licensed in this
4345 state who specializes in critical care;
4446 (4) one member who is a social worker or professional
4547 counselor licensed in this state;
4648 (5) one member who is a special education
4749 administrator for a school district;
4850 (6) one member who employs one or more music
4951 therapists;
5052 (7) one member who is a client, or a representative of
5153 a client, of a music therapist and has received music therapy
5254 services; and
5355 (8) one member who is:
5456 (A) a speech-language pathologist licensed in
5557 this state;
5658 (B) a physical therapist licensed in this state;
5759 or
5860 (C) an occupational therapist licensed in this
5961 state.
6062 (c) The lieutenant governor and the speaker of the house of
6163 representatives shall each submit to the governor a list of
6264 candidates who meet the qualifications for appointment under
6365 Subsection (b) of this section. The candidates must represent
6466 different racial, ethnic, and linguistic backgrounds.
6567 (d) Not later than the 90th day after the effective date of
6668 this Act, the governor shall appoint the nine members to the
6769 advisory council from the list of candidates submitted under
6870 Subsection (c) of this section.
6971 (e) The members of the advisory council shall designate a
7072 member of the advisory council to serve as presiding officer.
7173 (f) A member of the advisory council may not receive
7274 compensation for service on the advisory council.
7375 (g) The commission shall provide administrative and staff
7476 support for the advisory council.
7577 (h) The advisory council shall study the core competencies
7678 of a music therapist, including the skills and areas of knowledge
7779 that are essential to bringing about expanded health and wellness
7880 in diverse communities and reducing health disparities. The core
7981 competencies of a music therapist may also include basic knowledge
8082 of:
8183 (1) materials used to educate the public regarding
8284 music therapist certification;
8385 (2) the benefits of music therapy;
8486 (3) the use of music therapy by individuals and in
8587 facilities or institutional settings;
8688 (4) culturally competent communication and care;
8789 (5) the use of music therapy for behavior change;
8890 (6) the resources and support available from the
8991 American Music Therapy Association or its successor organization
9092 and the Certification Board for Music Therapists or its successor
9193 organization;
9294 (7) the educational and clinical training
9395 requirements for a music therapist; and
9496 (8) any continuing education requirements for a music
9597 therapist.
9698 (i) In conducting the study under Subsection (h) of this
9799 section, the advisory council shall consult with the American Music
98100 Therapy Association, the Certification Board for Music Therapists,
99101 and other experts as needed.
100102 SECTION 3. REPORT. (a) Not later than the second
101103 anniversary of the date of the advisory council's first meeting,
102104 the advisory council shall submit a report to the governor, the
103105 lieutenant governor, the speaker of the house of representatives,
104106 the Senate Committee on Health and Human Services, the House Public
105107 Health Committee, and the House Human Services Committee, or the
106108 successor to those committees, and the commission.
107109 (b) The report must include:
108110 (1) a summary of research regarding the best
109111 practices, curriculum, and training programs for music therapists
110112 and the need for quality and accredited training in providing music
111113 interventions related to health, recovery, and wellness;
112114 (2) recommendations regarding the need and
113115 feasibility of state certification of music therapists, including
114116 the impact of state certification on consumer access to music
115117 therapy services through state agencies, including the Texas
116118 Education Agency and the commission;
117119 (3) recommendations regarding procedures for the
118120 state certification of music therapists, including a system for the
119121 renewal of certifications and for the approval and accreditation of
120122 curriculum and training programs for music therapists; and
121123 (4) recommendations for best practices for
122124 third-party reimbursement options and other methods through which
123125 secure funding for music therapists may be obtained.
124126 (c) The commission shall publish the report on the
125127 commission's Internet website.
126128 SECTION 4. EXPIRATION DATE. The advisory council is
127129 abolished and this Act expires September 1, 2022.
128130 SECTION 5. EFFECTIVE DATE. This Act takes effect September
129131 1, 2019.
