4	10		AN ACT
5	11		relating to the creation of the University of Houston College of
6	12		Medicine at the University of Houston.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Chapter 111, Education Code, is amended by
9	15		adding Subchapter K to read as follows:
10	16		SUBCHAPTER K. UNIVERSITY OF HOUSTON COLLEGE OF MEDICINE
11	17		Sec. 111.151. DEFINITIONS. In this subchapter:
12	18		(1) "Board" means the board of regents of the
13	19		University of Houston System.
14	20		(2) "College" means the University of Houston College
15	21		of Medicine established under this subchapter.
16	22		Sec. 111.152. THE UNIVERSITY OF HOUSTON COLLEGE OF
17	23		MEDICINE. The University of Houston College of Medicine is a
18	24		college of the University of Houston and is under the management and
19	25		control of the board with degrees offered under the name and
20	26		authority of the University of Houston.
21	27		Sec. 111.153. COURSES AND DEGREES. The board may prescribe
22	28		courses leading to customary degrees and may adopt rules for the
23	29		operation, control, and management of the college as necessary for
24	30		conducting a college of medicine of the first class.
25	31		Sec. 111.154. AFFILIATION AGREEMENTS. The dean of the
26	32		college, on behalf of the board, may execute and carry out an
27	33		affiliation or coordinating agreement with any other entity or
28	34		institution in the college's region.
29	35		Sec. 111.155. GIFTS AND GRANTS. The board may solicit,
30	36		accept, and administer gifts and grants from any public or private
31	37		source for the use and benefit of the college.
32	38		Sec. 111.156. OTHER FACILITIES. In addition to the
33	39		college's facilities, the board may enter into agreements under
34	40		which additional facilities used in the college's teaching and
35	41		research programs, including libraries, auditoriums, research
36	42		facilities, and medical education buildings, may be provided by a
37	43		public or private entity.
38	44		Sec. 111.157. TEACHING HOSPITAL. A teaching hospital
39	45		considered suitable by the board may be provided by a public or
40	46		private entity. The hospital may not be constructed, maintained, or
41	47		operated with state funds.
42	48		SECTION 2. Sections 59.01(1) and (3), Education Code, are
43	49		amended to read as follows:
44	50		(1) "Medical staff or students" means medical doctors,
45	51		doctors of osteopathy, dentists, veterinarians, and podiatrists
46	52		appointed to the faculty or professional medical staff employed for
47	53		student health services by The University of Texas System, The
48	54		Texas A&M University System, the Texas Tech University System, the
49	55		University of Houston College of Medicine, or the University of
50	56		North Texas Health Science Center at Fort Worth, either full time or
51	57		who, although appointed less than full time (including volunteers),
52	58		either devote their total professional service to such appointment
53	59		or provide services to patients by assignment from the department
54	60		chairman; and interns, residents, fellows, and medical or dental
55	61		students, veterinary students, and students of osteopathy
56	62		participating in a patient-care program in The University of Texas
57	63		System, The Texas A&M University System, the Texas Tech University
58	64		System, the University of Houston College of Medicine, or the
59	65		University of North Texas Health Science Center at Fort Worth.
60	66		(3) "Board" means the board of regents of The
61	67		University of Texas System, the board of regents of The Texas A&M
62	68		University System, the board of regents of the Texas Tech
63	69		University System, the board of regents of the University of
64	70		Houston System, or the board of regents of the University of North
65	71		Texas.
66	72		SECTION 3. Sections 59.02(a) and (c), Education Code, are
67	73		amended to read as follows:
68	74		(a) Each board may establish a separate self-insurance fund
69	75		to pay any damages adjudged in a court of competent jurisdiction or
70	76		a settlement of any medical malpractice claim against a member of
71	77		the medical staff or students arising from the exercise of the
72	78		member's [his] appointment, duties, or training with The University
73	79		of Texas System, The Texas A&M University System, the Texas Tech
74	80		University System, the University of Houston College of Medicine,
75	81		or the University of North Texas Health Science Center at Fort
76	82		Worth.
77	83		(c) On the establishment of each fund, transfers to the fund
78	84		shall be made in an amount and at such intervals as determined by
79	85		the board. Each board may receive and accept any gifts or
80	86		donations specified for the purposes of this subchapter and deposit
81	87		those gifts or donations into the fund. Each board may invest
82	88		money deposited in the fund, and any income received shall be
83	89		retained in the fund. The money shall be deposited in any of the
84	90		approved depository banks of The University of Texas System, The
85	91		Texas A&M University System, the Texas Tech University System, the
86	92		University of Houston System, or the University of North Texas
87	93		Health Science Center at Fort Worth. All expenditures from the
88	94		funds shall be paid pursuant to approval by the boards.
89	95		SECTION 4. Section 59.06, Education Code, is amended to
90	96		read as follows:
91	97		Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
92	98		appropriated by the legislature to either system, to the Texas Tech
93	99		University Health Sciences Center, to the Texas Tech University
94	100		Health Sciences Center at El Paso, to the University of Houston for
95	101		the University of Houston College of Medicine, or to the University
96	102		of North Texas Health Science Center at Fort Worth from the General
97	103		Revenue Fund may not be used to establish or maintain the fund, to
98	104		purchase insurance, or to employ private legal counsel.
99	105		SECTION 5. Section 61.003(5), Education Code, is amended to
100	106		read as follows:
101	107		(5) "Medical and dental unit" means The Texas A&M
102	108		University System Health Science Center and its component
103	109		institutions, agencies, and programs; the Texas Tech University
104	110		Health Sciences Center; the Texas Tech University Health Sciences
105	111		Center at El Paso; the University of Houston College of Medicine;
106	112		The University of Texas Medical Branch at Galveston; The University
107	113		of Texas Southwestern Medical Center; The University of Texas
108	114		Medical School at San Antonio; The University of Texas Dental
109	115		Branch at Houston; The University of Texas M. D. Anderson Cancer
110	116		Center; The University of Texas Graduate School of Biomedical
111	117		Sciences at Houston; The University of Texas Dental School at San
112	118		Antonio; The University of Texas Medical School at Houston; The
113	119		University of Texas Health Science Center--South Texas and its
114	120		component institutions, if established under Subchapter N, Chapter
115	121		74; the nursing institutions of The Texas A&M University System and
116	122		The University of Texas System; and The University of Texas School
117	123		of Public Health at Houston; and such other medical or dental
118	124		schools as may be established by statute or as provided in this
119	125		chapter.
120	126		SECTION 6. Section 61.501(1), Education Code, is amended to
121	127		read as follows:
122	128		(1) "Medical school" means the medical school at The
123	129		University of Texas Health Science Center at Houston, the medical
124	130		school at The University of Texas Southwestern Medical Center, the
125	131		medical school at The University of Texas Health Science Center at
126	132		San Antonio, The University of Texas Medical Branch at Galveston,
127	133		the medical school at The University of Texas at Austin, the medical
128	134		school at The University of Texas Rio Grande Valley, the medical
129	135		education program of The University of Texas Health Science Center
130	136		at Tyler, the medical school at the Texas Tech University Health
131	137		Sciences Center, the medical school at the Texas Tech University
132	138		Health Sciences Center at El Paso, the University of Houston
133	139		College of Medicine, the Baylor College of Medicine, the college of
134	140		osteopathic medicine at the University of North Texas Health
135	141		Science Center at Fort Worth, or the medical school at the Texas A&M
136	142		University Health Science Center.
137	143		SECTION 7. Section 63.002(c), Education Code, is amended to
138	144		read as follows:
139	145		(c) The amount available for distribution from the fund may
140	146		be appropriated only for programs that benefit medical research,
141	147		health education, or treatment programs at the following
142	148		health-related institutions of higher education:
143	149		(1) The University of Texas Health Science Center at
144	150		San Antonio;
145	151		(2) The University of Texas M. D. Anderson Cancer
146	152		Center;
147	153		(3) The University of Texas Southwestern Medical
148	154		Center;
149	155		(4) The University of Texas Medical Branch at
150	156		Galveston;
151	157		(5) The University of Texas Health Science Center at
152	158		Houston;
153	159		(6) The University of Texas Health Science Center at
154	160		Tyler;
155	161		(7) The University of Texas Health Science
156	162		Center--South Texas and its component institutions, if established
157	163		under Subchapter N, Chapter 74;
158	164		(8) The Texas A&M University Health Science Center;
159	165		(9) the University of North Texas Health Science
160	166		Center at Fort Worth;
161	167		(10) the Texas Tech University Health Sciences Center;
162	168		(11) the Texas Tech University Health Sciences Center
163	169		at El Paso; [and]
164	170		(12) the University of Houston College of Medicine;
165	171		and
166	172		(13) Baylor College of Medicine, if a contract between
167	173		Baylor College of Medicine and the Texas Higher Education
168	174		Coordinating Board is in effect under Section 61.092.
169	175		SECTION 8. This Act takes effect immediately if it receives
170	176		a vote of two-thirds of all the members elected to each house, as
171	177		provided by Section 39, Article III, Texas Constitution. If this
172	178		Act does not receive the vote necessary for immediate effect, this
173	179		Act takes effect September 1, 2019.
