9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the creation of the University of Houston College of
612 Medicine at the University of Houston.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Chapter 111, Education Code, is amended by
915 adding Subchapter K to read as follows:
1016 SUBCHAPTER K. UNIVERSITY OF HOUSTON COLLEGE OF MEDICINE
1117 Sec. 111.151. DEFINITIONS. In this subchapter:
1218 (1) "Board" means the board of regents of the
1319 University of Houston System.
1420 (2) "College" means the University of Houston College
1521 of Medicine established under this subchapter.
1622 Sec. 111.152. THE UNIVERSITY OF HOUSTON COLLEGE OF
1723 MEDICINE. The University of Houston College of Medicine is a
1824 college of the University of Houston and is under the management and
1925 control of the board with degrees offered under the name and
2026 authority of the University of Houston.
2127 Sec. 111.153. COURSES AND DEGREES. The board may prescribe
2228 courses leading to customary degrees and may adopt rules for the
2329 operation, control, and management of the college as necessary for
2430 conducting a college of medicine of the first class.
2531 Sec. 111.154. AFFILIATION AGREEMENTS. The dean of the
2632 college, on behalf of the board, may execute and carry out an
2733 affiliation or coordinating agreement with any other entity or
2834 institution in the college's region.
2935 Sec. 111.155. GIFTS AND GRANTS. The board may solicit,
3036 accept, and administer gifts and grants from any public or private
3137 source for the use and benefit of the college.
3238 Sec. 111.156. OTHER FACILITIES. In addition to the
3339 college's facilities, the board may enter into agreements under
3440 which additional facilities used in the college's teaching and
3541 research programs, including libraries, auditoriums, research
3642 facilities, and medical education buildings, may be provided by a
3743 public or private entity.
3844 Sec. 111.157. TEACHING HOSPITAL. A teaching hospital
3945 considered suitable by the board may be provided by a public or
4046 private entity. The hospital may not be constructed, maintained, or
4147 operated with state funds.
4248 SECTION 2. Sections 59.01(1) and (3), Education Code, are
4349 amended to read as follows:
4450 (1) "Medical staff or students" means medical doctors,
4551 doctors of osteopathy, dentists, veterinarians, and podiatrists
4652 appointed to the faculty or professional medical staff employed for
4753 student health services by The University of Texas System, The
4854 Texas A&M University System, the Texas Tech University System, the
4955 University of Houston College of Medicine, or the University of
5056 North Texas Health Science Center at Fort Worth, either full time or
5157 who, although appointed less than full time (including volunteers),
5258 either devote their total professional service to such appointment
5359 or provide services to patients by assignment from the department
5460 chairman; and interns, residents, fellows, and medical or dental
5561 students, veterinary students, and students of osteopathy
5662 participating in a patient-care program in The University of Texas
5763 System, The Texas A&M University System, the Texas Tech University
5864 System, the University of Houston College of Medicine, or the
5965 University of North Texas Health Science Center at Fort Worth.
6066 (3) "Board" means the board of regents of The
6167 University of Texas System, the board of regents of The Texas A&M
6268 University System, the board of regents of the Texas Tech
6369 University System, the board of regents of the University of
6470 Houston System, or the board of regents of the University of North
6571 Texas.
6672 SECTION 3. Sections 59.02(a) and (c), Education Code, are
6773 amended to read as follows:
6874 (a) Each board may establish a separate self-insurance fund
6975 to pay any damages adjudged in a court of competent jurisdiction or
7076 a settlement of any medical malpractice claim against a member of
7177 the medical staff or students arising from the exercise of the
7278 member's [his] appointment, duties, or training with The University
7379 of Texas System, The Texas A&M University System, the Texas Tech
7480 University System, the University of Houston College of Medicine,
7581 or the University of North Texas Health Science Center at Fort
7682 Worth.
7783 (c) On the establishment of each fund, transfers to the fund
7884 shall be made in an amount and at such intervals as determined by
7985 the board. Each board may receive and accept any gifts or
8086 donations specified for the purposes of this subchapter and deposit
8187 those gifts or donations into the fund. Each board may invest
8288 money deposited in the fund, and any income received shall be
8389 retained in the fund. The money shall be deposited in any of the
8490 approved depository banks of The University of Texas System, The
8591 Texas A&M University System, the Texas Tech University System, the
8692 University of Houston System, or the University of North Texas
8793 Health Science Center at Fort Worth. All expenditures from the
8894 funds shall be paid pursuant to approval by the boards.
8995 SECTION 4. Section 59.06, Education Code, is amended to
9096 read as follows:
9197 Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
9298 appropriated by the legislature to either system, to the Texas Tech
9399 University Health Sciences Center, to the Texas Tech University
94100 Health Sciences Center at El Paso, to the University of Houston for
95101 the University of Houston College of Medicine, or to the University
96102 of North Texas Health Science Center at Fort Worth from the General
97103 Revenue Fund may not be used to establish or maintain the fund, to
98104 purchase insurance, or to employ private legal counsel.
99105 SECTION 5. Section 61.003(5), Education Code, is amended to
100106 read as follows:
101107 (5) "Medical and dental unit" means The Texas A&M
102108 University System Health Science Center and its component
103109 institutions, agencies, and programs; the Texas Tech University
104110 Health Sciences Center; the Texas Tech University Health Sciences
105111 Center at El Paso; the University of Houston College of Medicine;
106112 The University of Texas Medical Branch at Galveston; The University
107113 of Texas Southwestern Medical Center; The University of Texas
108114 Medical School at San Antonio; The University of Texas Dental
109115 Branch at Houston; The University of Texas M. D. Anderson Cancer
110116 Center; The University of Texas Graduate School of Biomedical
111117 Sciences at Houston; The University of Texas Dental School at San
112118 Antonio; The University of Texas Medical School at Houston; The
113119 University of Texas Health Science Center--South Texas and its
114120 component institutions, if established under Subchapter N, Chapter
115121 74; the nursing institutions of The Texas A&M University System and
116122 The University of Texas System; and The University of Texas School
117123 of Public Health at Houston; and such other medical or dental
118124 schools as may be established by statute or as provided in this
119125 chapter.
120126 SECTION 6. Section 61.501(1), Education Code, is amended to
121127 read as follows:
122128 (1) "Medical school" means the medical school at The
123129 University of Texas Health Science Center at Houston, the medical
124130 school at The University of Texas Southwestern Medical Center, the
125131 medical school at The University of Texas Health Science Center at
126132 San Antonio, The University of Texas Medical Branch at Galveston,
127133 the medical school at The University of Texas at Austin, the medical
128134 school at The University of Texas Rio Grande Valley, the medical
129135 education program of The University of Texas Health Science Center
130136 at Tyler, the medical school at the Texas Tech University Health
131137 Sciences Center, the medical school at the Texas Tech University
132138 Health Sciences Center at El Paso, the University of Houston
133139 College of Medicine, the Baylor College of Medicine, the college of
134140 osteopathic medicine at the University of North Texas Health
135141 Science Center at Fort Worth, or the medical school at the Texas A&M
136142 University Health Science Center.
137143 SECTION 7. Section 63.002(c), Education Code, is amended to
138144 read as follows:
139145 (c) The amount available for distribution from the fund may
140146 be appropriated only for programs that benefit medical research,
141147 health education, or treatment programs at the following
142148 health-related institutions of higher education:
143149 (1) The University of Texas Health Science Center at
144150 San Antonio;
145151 (2) The University of Texas M. D. Anderson Cancer
146152 Center;
147153 (3) The University of Texas Southwestern Medical
148154 Center;
149155 (4) The University of Texas Medical Branch at
150156 Galveston;
151157 (5) The University of Texas Health Science Center at
152158 Houston;
153159 (6) The University of Texas Health Science Center at
154160 Tyler;
155161 (7) The University of Texas Health Science
156162 Center--South Texas and its component institutions, if established
157163 under Subchapter N, Chapter 74;
158164 (8) The Texas A&M University Health Science Center;
159165 (9) the University of North Texas Health Science
160166 Center at Fort Worth;
161167 (10) the Texas Tech University Health Sciences Center;
162168 (11) the Texas Tech University Health Sciences Center
163169 at El Paso; [and]
164170 (12) the University of Houston College of Medicine;
165171 and
166172 (13) Baylor College of Medicine, if a contract between
167173 Baylor College of Medicine and the Texas Higher Education
168174 Coordinating Board is in effect under Section 61.092.
169175 SECTION 8. This Act takes effect immediately if it receives
170176 a vote of two-thirds of all the members elected to each house, as
171177 provided by Section 39, Article III, Texas Constitution. If this
172178 Act does not receive the vote necessary for immediate effect, this
173179 Act takes effect September 1, 2019.
