78 relating to safety requirements for a person directly operating an
89 amusement ride.
910 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1011 SECTION 1. Subchapter C, Chapter 2151, Occupations Code, is
1112 amended by adding Section 2151.1013 to read as follows:
1213 Sec. 2151.1013. AMUSEMENT RIDE ATTENDANT SAFETY
13- REQUIREMENTS. (a) In this section:
14- (1) "Dispatcher" means a ride operator stationed at
15- the top of an elevated waterslide to maintain order, direct patrons
16- on when to depart the top of the slide, and ensure patrons begin the
17- ride safely.
18- (2) "Ride operator" means a person actually engaged in
19- the control of an amusement ride or directly controlling an
20- amusement ride. The term does not include a certified lifeguard,
21- other than a certified lifeguard working as a dispatcher, on a
22- water-based amusement ride.
23- (b) A ride operator must be:
14+ REQUIREMENTS. (a) In this section, "attendant" means a person
15+ directly operating an amusement ride.
16+ (b) To directly operate an amusement ride, an attendant must
17+ be:
2418 (1) at least 16 years of age; and
2519 (2) trained in the proper use and operation of the
26- amusement ride the person is operating.
27- (c) A ride operator may not operate more than one amusement
28- ride simultaneously unless the operator is working as a dispatcher
29- for adjacent or proximate elevated waterslides.
30- (d) A ride operator may not operate an amusement ride if the
31- operator's operation of the ride constitutes an offense under
32- Section 49.065, Penal Code.
20+ amusement ride the attendant is operating.
21+ (c) An attendant may not directly operate an amusement ride:
22+ (1) while the attendant is directly and simultaneously
23+ operating another amusement ride; or
24+ (2) if operation by the attendant constitutes an
25+ offense under Section 49.065, Penal Code.
3326 SECTION 2. This Act takes effect September 1, 2019.
