95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to establishment of the disaster identification system for
128 a declared state of disaster.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 418.004, Government Code, is amended by
1511 adding Subdivision (3-a) to read as follows:
1612 (3-a) "Illuminated display" means a device that:
1713 (A) displays blue, green, red, and yellow colors
1814 or the color white; and
1915 (B) displays a flashing light and a continuous
2016 light.
2117 SECTION 2. Section 418.015(a), Government Code, is amended
2218 to read as follows:
2319 (a) An executive order or proclamation declaring a state of
2420 disaster:
2521 (1) activates the disaster recovery and
2622 rehabilitation aspects of the state emergency management plan
2723 applicable to the area subject to the declaration; [and]
2824 (2) authorizes the deployment and use of any forces to
2925 which the plan applies and the use or distribution of any supplies,
3026 equipment, and materials or facilities assembled, stockpiled, or
3127 arranged to be made available under this chapter or other law
3228 relating to disasters; and
3329 (3) activates for the area subject to the declaration
3430 the disaster identification system described by Section 418.0155.
3531 SECTION 3. Subchapter B, Chapter 418, Government Code, is
3632 amended by adding Section 418.0155 to read as follows:
3733 Sec. 418.0155. DISASTER IDENTIFICATION SYSTEM. (a) In an
3834 area subject to a declaration of a state of disaster under Section
3935 418.014, a person may use an illuminated display to communicate
4036 with disaster relief personnel. A person who elects to participate
4137 in the disaster identification system shall:
4238 (1) affix to each individual and domesticated animal
4339 in the person's household an illuminated display of the following
4440 colors:
4541 (A) if the person has a monochromatic illuminated
4642 display, the color white for each individual and animal; or
4743 (B) if the person has a multicolored illuminated
4844 display:
4945 (i) blue for each individual 18 years of age
5046 or older;
5147 (ii) green for each individual with a
5248 disability;
5349 (iii) red for each individual younger than
5450 18 years of age; and
5551 (iv) yellow for each animal; and
5652 (2) using the illuminated display, signal to disaster
5753 relief personnel responding to the area after the disaster with:
5854 (A) a continuous light on the display of each
5955 household member who does not need medical assistance; or
6056 (B) a flashing light on the display of each
6157 household member who needs medical assistance.
6258 (b) Disaster relief personnel may patrol the designated
6359 disaster area by air or ground at night to locate persons with
6460 activated illuminated displays.
6561 SECTION 4. Section 418.042(a), Government Code, is amended
6662 to read as follows:
6763 (a) The division shall prepare and keep current a
6864 comprehensive state emergency management plan. The plan may
6965 include:
7066 (1) provisions for prevention and minimization of
7167 injury and damage caused by disaster;
7268 (2) provisions for prompt and effective response to
7369 disaster;
7470 (3) provisions for emergency relief;
7571 (4) provisions for energy emergencies;
7672 (5) identification of areas particularly vulnerable
7773 to disasters;
7874 (6) recommendations for zoning, building
7975 restrictions, and other land-use controls, safety measures for
8076 securing mobile homes or other nonpermanent or semipermanent
8177 structures, and other preventive and preparedness measures
8278 designed to eliminate or reduce disasters or their impact;
8379 (7) provisions for assistance to local officials in
8480 designing local emergency management plans;
8581 (8) authorization and procedures for the erection or
8682 other construction of temporary works designed to protect against
8783 or mitigate danger, damage, or loss from flood, fire, or other
8884 disaster;
8985 (9) preparation and distribution to the appropriate
9086 state and local officials of state catalogs of federal, state, and
9187 private assistance programs;
9288 (10) organization of manpower and channels of
9389 assistance;
9490 (11) coordination of federal, state, and local
9591 emergency management activities;
9692 (12) coordination of the state emergency management
9793 plan with the emergency management plans of the federal government;
9894 (13) coordination of federal and state energy
9995 emergency plans;
10096 (14) provisions for providing information to local
10197 officials on activation of the Emergency Alert System established
10298 under 47 C.F.R. Part 11;
10399 (15) a database of public facilities that may be used
104100 under Section 418.017 to shelter individuals during a disaster,
105101 including air-conditioned facilities for shelter during an extreme
106102 heat disaster and fortified structures for shelter during a wind
107103 disaster;
108104 (16) provisions for quickly replenishing the food
109105 supplies of area food banks or food pantries following a disaster;
110106 (17) provisions for the use of the disaster
111107 identification system described by Section 418.0155; and
112108 (18) [(17)] other necessary matters relating to
113109 disasters.
114110 SECTION 5. This Act takes effect September 1, 2019.
