411 AN ACT
512 relating to the membership and training course requirements of a
613 public school concussion oversight team and the removal of a public
714 school student from an interscholastic athletic activity on the
815 basis of a suspected concussion.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Section 38.154, Education Code, is amended by
1118 adding Subsection (b-1) to read as follows:
1219 (b-1) If a school district or open-enrollment charter
1320 school employs a school nurse, the school nurse may be a member of
1421 the district or charter school concussion oversight team if
1522 requested by the school nurse.
1623 SECTION 2. Section 38.156, Education Code, is amended to
1724 read as follows:
1825 Sec. 38.156. REMOVAL FROM PLAY IN PRACTICE OR COMPETITION
1926 FOLLOWING CONCUSSION. A student shall be removed from an
2027 interscholastic athletics practice or competition immediately if
2128 one of the following persons believes the student might have
2229 sustained a concussion during the practice or competition:
2330 (1) a coach;
2431 (2) a physician;
2532 (3) a licensed health care professional;
2633 (4) a person licensed under Chapter 201, Occupations
2734 Code; [or]
2835 (5) a school nurse; or
2936 (6) the student's parent or guardian or another person
3037 with legal authority to make medical decisions for the student.
3138 SECTION 3. Sections 38.158(c), (e), and (g), Education
3239 Code, are amended to read as follows:
3340 (c) The following persons must take a training course in
3441 accordance with Subsection (e) from an authorized training provider
3542 at least once every two years:
3643 (1) a coach of an interscholastic athletic activity;
3744 (2) a school nurse who serves as a member of a
3845 concussion oversight team;
3946 (3) a licensed health care professional who serves as
4047 a member of a concussion oversight team and is an employee,
4148 representative, or agent of a school district or open-enrollment
4249 charter school; and
4350 (4) [(3)] a licensed health care professional who
4451 serves on a volunteer basis as a member of a concussion oversight
4552 team for a school district or open-enrollment charter school.
4653 (e) For purposes of Subsection (c):
4754 (1) a coach must take a course described by Subsection
4855 (a);
4956 (2) an athletic trainer must take:
5057 (A) a course described by Subsection (b); or
5158 (B) a course concerning the subject matter of
5259 concussions that has been approved for continuing education credit
5360 by the appropriate licensing authority for the profession; and
5461 (3) a school nurse or licensed health care
5562 professional, other than an athletic trainer, must take:
5663 (A) a course described by Subsection (a) or (b);
5764 or
5865 (B) a course concerning the subject matter of
5966 concussions that has been approved for continuing education credit
6067 by the appropriate licensing authority for the profession.
6168 (g) A school nurse or licensed health care professional who
6269 is not in compliance with the training requirements under this
6370 section may not serve on a concussion oversight team in any
6471 capacity.
6572 SECTION 4. This Act takes effect immediately if it receives
6673 a vote of two-thirds of all the members elected to each house, as
6774 provided by Section 39, Article III, Texas Constitution. If this
6875 Act does not receive the vote necessary for immediate effect, this
6976 Act takes effect September 1, 2019.
