410 AN ACT
511 relating to the deployment of advanced metering and meter
612 information networks by certain non-ERCOT utilities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 39.402, Utilities Code, is amended by
915 adding Subsections (e) and (f) to read as follows:
1016 (e) Notwithstanding Subsection (a), an electric utility
1117 subject to this subchapter that elects to deploy advanced metering
1218 and meter information networks may recover reasonable and necessary
1319 costs incurred in deploying advanced metering and meter information
1420 networks. An electric utility that elects to deploy advanced
1521 metering or meter information networks is subject to commission
1622 rules adopted under Sections 39.107(h) and (k). The commission
1723 shall ensure that any deployment plan approved under this section
1824 and any related customer surcharge:
1925 (1) are not applicable to customer accounts that
2026 receive service at transmission voltage; and
2127 (2) are consistent with commission rules related to
2228 advanced metering systems regarding:
2329 (A) customer protections;
2430 (B) data security, privacy, and ownership; and
2531 (C) options given consumers to continue to
2632 receive service through a non-advanced meter.
2733 (f) An electric utility subject to this subchapter that
2834 elects to deploy an advanced meter information network shall deploy
2935 the network as rapidly as practicable to allow customers to better
3036 manage energy use and control costs.
3137 SECTION 2. This Act takes effect immediately if it receives
3238 a vote of two-thirds of all the members elected to each house, as
3339 provided by Section 39, Article III, Texas Constitution. If this
3440 Act does not receive the vote necessary for immediate effect, this
3541 Act takes effect September 1, 2019.
