4	6		AN ACT
5	7		relating to the authority of physicians to delegate to certain
6	8		pharmacists the implementation and modification of a patient's drug
7	9		therapy.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 157.101(b-1), Occupations Code, is
10	12		amended to read as follows:
11	13		(b-1) A delegation under Subsection (b) may include:
12	14		(1) the implementation or modification of a patient's
13	15		drug therapy under a protocol if:
14	16		(A) the delegation follows a diagnosis, initial
15	17		patient assessment, and drug therapy order by the physician; and
16	18		(B) the pharmacist maintains a copy of the
17	19		protocol for inspection until at least the seventh anniversary of
18	20		the expiration date of the protocol; or
19	21		(2) [, including] the authority to sign a prescription
20	22		drug order for dangerous drugs for a patient[,] if:
21	23		(A) [(1)] the delegation follows a diagnosis,
22	24		initial patient assessment, and drug therapy order by the
23	25		physician;
24	26		(B) [(2)] the pharmacist practices in a
25	27		hospital, hospital-based clinic, or an academic health care
26	28		institution;
27	29		(C) [(3)] the hospital, hospital-based clinic,
28	30		or academic health care institution in which the pharmacist
29	31		practices has bylaws and a medical staff policy that permit a
30	32		physician to delegate to a pharmacist the management of a patient's
31	33		drug therapy;
32	34		(D) [(4)] the pharmacist provides the name,
33	35		address, and telephone number of the pharmacist and of the
34	36		delegating physician on each prescription signed by the pharmacist;
35	37		and
36	38		(E) [(5)] the pharmacist provides a copy of the
37	39		protocol to the Texas State Board of Pharmacy.
38	40		SECTION 2. Not later than December 1, 2019, the Texas State
39	41		Board of Pharmacy shall adopt rules necessary to implement Section
40	42		554.057, Occupations Code.
41	43		SECTION 3. This Act takes effect September 1, 2019.
