54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to reports on the prevalence of eating disorders and
87 eating disorder-related deaths in this state.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. (a) The Department of State Health Services, in
1110 collaboration with the Health and Human Services Commission, shall
1211 prepare a report on the prevalence of eating disorders and eating
1312 disorder-related deaths in this state. The report must include:
1413 (1) statewide and regional statistics regarding the
1514 prevalence of eating disorders and eating disorder-related deaths
1615 in this state;
1716 (2) an overview of national trends in eating
1817 disorders; and
1918 (3) an overview of state-funded behavioral health
2019 treatment options available to persons with eating disorders.
2120 (b) The Department of State Health Services shall gather
2221 information for the report required by Subsection (a) of this
2322 section from:
2423 (1) information collected by the department and the
2524 Health and Human Services Commission, including information from
2625 the vital statistics unit and the state Medicaid program; and
2726 (2) hospitals, treatment centers, available surveys,
2827 and other relevant sources.
2928 (c) Not later than December 1, 2020, the Department of State
3029 Health Services and the Health and Human Services Commission shall
3130 prepare and submit to the legislature a copy of the report and any
3231 recommendations for legislative or other action to reduce the
3332 prevalence of eating disorders in this state. The department may
3433 post the report on the department's Internet website.
3534 (d) The Department of State Health Services may accept
3635 gifts, grants, and donations from any source to fund expenses
3736 incurred by the department in preparing the report under this
3837 section.
3938 (e) This section expires September 1, 2021.
4039 SECTION 2. (a) The Department of State Health Services
4140 shall prepare a report on the prevalence of eating disorders among
4241 youth in this state. When administering the Youth Risk Behavior
4342 Survey created by the federal Centers for Disease Control and
4443 Prevention to youth in this state, the department may include
4544 additional questions as necessary to assist the department in
4645 assessing the prevalence of eating disorders among youth in this
4746 state for purposes of the report.
4847 (b) Not later than December 1, 2022, the Department of State
4948 Health Services shall submit to the legislature a copy of the report
5049 and a summary of the survey findings relating to the prevalence of
5150 eating disorders among youth in this state. The department may post
5251 the report and summary on the department's Internet website.
5352 (c) The Department of State Health Services may accept
5453 gifts, grants, and donations from any source to fund expenses
5554 incurred by the department in preparing the report under this
5655 section.
5756 (d) This section expires September 1, 2023.
5857 SECTION 3. The Department of State Health Services is
5958 required to implement a provision of this Act only if the department
6059 receives gifts, grants, or donations specifically for that purpose
6160 or the legislature appropriates money specifically for that
6261 purpose. If the legislature does not appropriate money
6362 specifically for that purpose and the department does not receive
6463 gifts, grants, or donations specifically for that purpose, the
6564 department may, but is not required to, implement a provision of
6665 this Act using other appropriations available for that purpose.
6766 SECTION 4. This Act takes effect immediately if it receives
6867 a vote of two-thirds of all the members elected to each house, as
6968 provided by Section 39, Article III, Texas Constitution. If this
7069 Act does not receive the vote necessary for immediate effect, this
7170 Act takes effect September 1, 2019.
