46 AN ACT
57 relating to the consideration of certain arrests in determining an
68 applicant's eligibility for an occupational license.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter B, Chapter 53, Occupations Code, is
911 amended by adding Section 53.0231 to read as follows:
1012 Sec. 53.0231. LIMITATION REGARDING CONSIDERATION OF
1113 CERTAIN ARRESTS. For purposes of determining a person's fitness to
1214 perform the duties and discharge the responsibilities of the
1315 licensed occupation, a licensing authority may not consider an
1416 arrest that did not result in the person's conviction or placement
1517 on deferred adjudication community supervision.
1618 SECTION 2. This Act takes effect immediately if it receives
1719 a vote of two-thirds of all the members elected to each house, as
1820 provided by Section 39, Article III, Texas Constitution. If this
1921 Act does not receive the vote necessary for immediate effect, this
2022 Act takes effect September 1, 2019.
