4	6		AN ACT
5	7		relating to annexation by certain municipalities of a special
6	8		district under a strategic partnership agreement.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Section 43.0751(s), Local Government Code, is
9	11		amended to read as follows:
10	12		(s) Notwithstanding any other law other than Section
11	13		43.083, the procedures prescribed by Subchapters C-3, C-4, and C-5
12	14		do not apply to the annexation of an area under this section.
13	15		Except as provided by Subsection (h), a municipality shall follow
14	16		the procedures established under the strategic partnership
15	17		agreement for full-purpose annexation of an area under this
16	18		section.
17	19		SECTION 2. Subchapter D, Chapter 43, Local Government Code,
18	20		is amended by adding Section 43.083 to read as follows:
19	21		Sec. 43.083. ANNEXATION BY CERTAIN MUNICIPALITIES THAT
20	22		OPERATE MUNICIPALLY OWNED WATER UTILITY. (a) This section applies
21	23		only to a municipality that:
22	24		(1) operates a municipally owned water utility; and
23	25		(2) is a party to a strategic partnership agreement:
24	26		(A) with a municipal utility district; and
25	27		(B) under which the municipality contemplates
26	28		annexing 400 or more water or wastewater connections that are not
27	29		located in the district.
28	30		(b) A municipality authorized or required to annex a
29	31		district for full purposes under a strategic partnership agreement
30	32		under Section 43.0751:
31	33		(1) may not annex the district without also annexing
32	34		all of the unincorporated area served by the district that is
33	35		located in the municipality's extraterritorial jurisdiction; and
34	36		(2) must receive approval for the annexations under
35	37		the agreement and Subdivision (1) as required by Subchapter C-3,
36	38		C-4, or C-5, as applicable, before annexation.
	39	+	(c) The above subsection shall not apply to a county with a
	40	+	population of more than 1.7 million.
37	41		SECTION 3. This Act takes effect immediately if it receives
38	42		a vote of two-thirds of all the members elected to each house, as
39	43		provided by Section 39, Article III, Texas Constitution. If this
40	44		Act does not receive the vote necessary for immediate effect, this
41	45		Act takes effect September 1, 2019.
