5	10		AN ACT
6	11		relating to the resignation or termination or nonrenewal of the
7	12		contract of a superintendent of a school district.
8	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	14		SECTION 1. Subchapter E, Chapter 11, Education Code, is
10	15		amended by adding Section 11.2011 to read as follows:
11	16		Sec. 11.2011. SUPERINTENDENT RESIGNATION OR TERMINATION OR
12	17		NONRENEWAL OF CONTRACT. (a) If the superintendent of a school
13	18		district leaves the employment of the district by resignation or by
14	19		the termination or nonrenewal of a contract, the school district
15	20		shall:
16	21		(1) post on the school district's Internet website, if
17	22		any:
18	23		(A) a notice of the resignation, termination, or
19	24		nonrenewal that includes any grounds for the resignation,
20	25		termination, or nonrenewal; and
21	26		(B) a copy of any agreement related to the
22	27		resignation, termination, or nonrenewal entered into between the
23	28		superintendent and the school district; and
24	29		(2) report the information required by Subdivision (1)
25	30		to the agency.
26	31		(b) The agency shall post the information sent to the agency
27	32		under Subsection (a)(2) on the agency's Internet website.
28	33		(c) A contract or agreement between a school district and a
29	34		superintendent may not include:
30	35		(1) a confidentiality provision regarding the
31	36		resignation, termination, or nonrenewal or a resignation,
32	37		termination, or nonrenewal agreement or the grounds for
33	38		resignation, termination, or nonrenewal; or
34	39		(2) a provision prohibiting the district or agency
35	40		from posting the information required by Subsection (a)(1) on the
36	41		district's or agency's Internet website.
37	42		(d) The commissioner shall adopt rules to implement this
38	43		section.
39	44		SECTION 2. (a) Except as provided by Subsection (b) of
40	45		this section, this Act applies only to a resignation, termination,
41	46		or nonrenewal that occurs on or after the effective date of this
42	47		Act. A resignation, termination, or nonrenewal that occurred
43	48		before that date is governed by the law as it existed at the time the
44	49		resignation, termination, or nonrenewal occurred, and the former
45	50		law is continued in effect for that purpose.
46	51		(b) If a superintendent resigns or the superintendent's
47	52		contract is terminated or not renewed on or after the effective date
48	53		of this Act and the superintendent was, on the date of resignation,
49	54		termination, or nonrenewal, subject to an employment contract that
50	55		contains provisions that conflict with Section 11.2011, Education
51	56		Code, as added by this Act, the provisions of the employment
52	57		contract control to the extent of conflict during the term of that
53	58		contract.
54	59		(c) Section 11.2011(c), Education Code, as added by this
55	60		Act, applies only to an employment contract that is entered into or
56	61		renewed on or after the effective date of this Act. An employment
57	62		contract entered into or renewed before that date is governed by the
58	63		law as it existed at the time the employment contract was entered
59	64		into or renewed, and the former law is continued in effect for that
60	65		purpose.
61	66		SECTION 3. This Act takes effect September 1, 2019.
