49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the resignation or termination or nonrenewal of the
712 contract of a superintendent of a school district.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Subchapter E, Chapter 11, Education Code, is
1015 amended by adding Section 11.2011 to read as follows:
1116 Sec. 11.2011. SUPERINTENDENT RESIGNATION OR TERMINATION OR
1217 NONRENEWAL OF CONTRACT. (a) If the superintendent of a school
1318 district leaves the employment of the district by resignation or by
1419 the termination or nonrenewal of a contract, the school district
1520 shall:
1621 (1) post on the school district's Internet website, if
1722 any:
1823 (A) a notice of the resignation, termination, or
1924 nonrenewal that includes any grounds for the resignation,
2025 termination, or nonrenewal; and
2126 (B) a copy of any agreement related to the
2227 resignation, termination, or nonrenewal entered into between the
2328 superintendent and the school district; and
2429 (2) report the information required by Subdivision (1)
2530 to the agency.
2631 (b) The agency shall post the information sent to the agency
2732 under Subsection (a)(2) on the agency's Internet website.
2833 (c) A contract or agreement between a school district and a
2934 superintendent may not include:
3035 (1) a confidentiality provision regarding the
3136 resignation, termination, or nonrenewal or a resignation,
3237 termination, or nonrenewal agreement or the grounds for
3338 resignation, termination, or nonrenewal; or
3439 (2) a provision prohibiting the district or agency
3540 from posting the information required by Subsection (a)(1) on the
3641 district's or agency's Internet website.
3742 (d) The commissioner shall adopt rules to implement this
3843 section.
3944 SECTION 2. (a) Except as provided by Subsection (b) of
4045 this section, this Act applies only to a resignation, termination,
4146 or nonrenewal that occurs on or after the effective date of this
4247 Act. A resignation, termination, or nonrenewal that occurred
4348 before that date is governed by the law as it existed at the time the
4449 resignation, termination, or nonrenewal occurred, and the former
4550 law is continued in effect for that purpose.
4651 (b) If a superintendent resigns or the superintendent's
4752 contract is terminated or not renewed on or after the effective date
4853 of this Act and the superintendent was, on the date of resignation,
4954 termination, or nonrenewal, subject to an employment contract that
5055 contains provisions that conflict with Section 11.2011, Education
5156 Code, as added by this Act, the provisions of the employment
5257 contract control to the extent of conflict during the term of that
5358 contract.
5459 (c) Section 11.2011(c), Education Code, as added by this
5560 Act, applies only to an employment contract that is entered into or
5661 renewed on or after the effective date of this Act. An employment
5762 contract entered into or renewed before that date is governed by the
5863 law as it existed at the time the employment contract was entered
5964 into or renewed, and the former law is continued in effect for that
6065 purpose.
6166 SECTION 3. This Act takes effect September 1, 2019.
