66 AN ACT
77 relating to the licensing and regulation of driver education
88 schools and instructors; authorizing fees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1001.001(7), Education Code, is amended
1111 to read as follows:
1212 (7) "Driver education school" means an enterprise
1313 that:
1414 (A) maintains a place of business or solicits
1515 business in this state; and
1616 (B) is operated by an individual, association,
1717 partnership, or corporation for educating and training persons [at
1818 a primary or branch location] in driver education or driver
1919 education instructor development.
2020 SECTION 2. Section 1001.151(e), Education Code, is amended
2121 to read as follows:
2222 (e) The commission may establish a fee for an application
2323 for approval to offer a driver education course [by an alternative
2424 method of instruction under Section 1001.3541].
2525 SECTION 3. Section 1001.204(b), Education Code, is amended
2626 to read as follows:
2727 (b) The department shall approve an application for a driver
2828 education school license if the application is submitted on a form
2929 approved by the department [executive director], the application is
3030 accompanied by [includes] the fee, and the department determines
3131 [on inspection of the premises of the school, it is determined] that
3232 the school:
3333 (1) has courses, curricula, and instruction of a
3434 quality, content, and length that reasonably and adequately achieve
3535 the stated objective for which the courses, curricula, and
3636 instruction are offered;
3737 (2) has adequate space, equipment, instructional
3838 material, and instructors to provide training of good quality in
3939 the classroom and behind the wheel, if applicable;
4040 (3) has instructors who have adequate educational
4141 qualifications and experience;
4242 (4) provides to each student before enrollment:
4343 (A) a copy of:
4444 (i) the refund policy;
4545 (ii) the schedule of tuition, fees, and
4646 other charges; and
4747 (iii) the regulations relating to absence,
4848 grading policy, and rules of operation and conduct; and
4949 (B) the department's name, mailing address,
5050 telephone number, and Internet website address for the purpose of
5151 directing complaints to the department;
5252 (5) maintains adequate records as prescribed by the
5353 department to show attendance and progress or grades and enforces
5454 satisfactory standards relating to attendance, progress, and
5555 conduct;
5656 (6) on completion of training, issues each student a
5757 certificate indicating the course name and satisfactory
5858 completion;
5959 (7) complies with all county, municipal, state, and
6060 federal regulations, including fire, building, and sanitation
6161 codes and assumed name registration, if applicable;
6262 (8) is financially sound and capable of fulfilling its
6363 commitments for training;
6464 (9) maintains and publishes as part of its student
6565 enrollment contract the proper policy for the refund of the unused
6666 portion of tuition, fees, and other charges if a student fails to
6767 take the course or withdraws or is discontinued from the school at
6868 any time before completion;
6969 (10) does not use erroneous or misleading advertising,
7070 either by actual statement, omission, or intimation, as determined
7171 by the department;
7272 (11) does not use a name similar to the name of another
7373 existing school or tax-supported educational institution in this
7474 state, unless specifically approved in writing by the executive
7575 director;
7676 (12) submits to the department for approval the
7777 applicable course hour lengths and curriculum content for each
7878 course offered by the school;
7979 (13) does not owe an administrative penalty for a
8080 violation of this chapter; [and]
8181 (14) meets any additional criteria required by the
8282 department, including any applicable inspection requirements; and
8383 (15) provides adequate testing and security measures
8484 for the school's method of instruction.
8585 SECTION 4. Subchapter F, Chapter 1001, Education Code, is
8686 amended by adding Sections 1001.2531, 1001.2532, 1001.2533,
8787 1001.2534, and 1001.2535 to read as follows:
8888 Sec. 1001.2531. DRIVER EDUCATION INSTRUCTOR REQUIREMENTS.
8989 (a) The commission by rule shall establish standards for a driver
9090 education instructor to be certified as a teaching assistant,
9191 driver education teacher, or supervising teacher.
9292 (b) An applicant for a driver education instructor license
9393 under this section must:
9494 (1) apply to the department on a form prescribed by the
9595 department and under rules adopted by the commission;
9696 (2) submit with the application a nonrefundable
9797 application fee in an amount set by commission rule; and
9898 (3) present satisfactory evidence to the department
9999 that the applicant:
100100 (A) is at least 21 years of age;
101101 (B) holds a high school diploma or high school
102102 equivalency certificate; and
103103 (C) meets any other requirement established by
104104 commission rule.
105105 Sec. 1001.2532. TEACHING ASSISTANT. (a) A teaching
106106 assistant is a driver education instructor who is authorized to
107107 teach or provide only behind-the-wheel training.
108108 (b) To be eligible to be certified as a teaching assistant,
109109 a driver education instructor must:
110110 (1) have successfully completed:
111111 (A) six semester hours of driver and traffic
112112 safety education from an accredited college or university; or
113113 (B) a teaching assistant development course
114114 approved by the department; and
115115 (2) pass any required examination.
116116 Sec. 1001.2533. DRIVER EDUCATION TEACHER. (a) A driver
117117 education teacher is a driver education instructor who is
118118 authorized to teach or provide behind-the-wheel training and
119119 classroom training.
120120 (b) To be eligible to be certified as a driver education
121121 teacher, a driver education instructor must:
122122 (1) have successfully completed:
123123 (A) nine semester hours of driver and traffic
124124 safety education from an accredited college or university; or
125125 (B) a driver education teacher development
126126 course approved by the department;
127127 (2) pass any required examination; and
128128 (3) comply with the additional requirements under
129129 Section 1001.2535.
130130 Sec. 1001.2534. SUPERVISING TEACHER. (a) A supervising
131131 teacher is a driver education instructor who is authorized to teach
132132 instructor training classes.
133133 (b) To be eligible to be certified as a supervising teacher,
134134 a driver education instructor must:
135135 (1) have been certified as a driver education teacher
136136 for at least one year; and
137137 (2) have successfully completed:
138138 (A) 15 semester hours of driver and traffic
139139 safety education from an accredited college or university; or
140140 (B) a supervising teacher development course
141141 approved by the department; and
142142 (3) comply with the additional requirements under
143143 Section 1001.2535.
144144 Sec. 1001.2535. ADDITIONAL REQUIREMENTS FOR DRIVER
145145 EDUCATION TEACHER AND SUPERVISING TEACHER. (a) In addition to the
146146 requirements under Section 1001.2533 or 1001.2534, as applicable,
147147 to be eligible to be certified as a driver education teacher or
148148 supervising teacher, a driver education instructor must:
149149 (1) hold a teaching certificate and any additional
150150 certification required by commission rule to teach driver
151151 education;
152152 (2) have completed 15 semester hours in education
153153 courses at an accredited college or university during the 10 years
154154 before the application date; or
155155 (3) have obtained an associate or baccalaureate degree
156156 in education from an accredited college or university.
157157 (b) The commission, department, or executive director may
158158 adopt an alternative method to determine or verify an instructor's
159159 eligibility under Subsection (a).
160160 SECTION 5. Subchapter H, Chapter 1001, Education Code, is
161161 amended by adding Section 1001.3542 to read as follows:
162162 Sec. 1001.3542. METHOD OF INSTRUCTION FOR DRIVER EDUCATION
163163 COURSE. A driver education school may teach a driver education
164164 course by any method approved by the department, including an
165165 alternative method under Section 1001.3541 or a traditional method
166166 under Subchapter C.
167167 SECTION 6. The following provisions of the Education Code
168168 are repealed:
169169 (1) Sections 1001.253, 1001.254, and 1001.256; and
170170 (2) Section 1001.3541(b).
171171 SECTION 7. (a) As soon as practicable after the effective
172172 date of this Act, the Texas Commission on Licensing and Regulation
173173 shall adopt rules to implement Section 1001.204(b), Education Code,
174174 as amended by this Act, and Section 1001.2531, Education Code, as
175175 added by this Act.
176176 (b) A driver education instructor license issued under
177177 Section 1001.253, Education Code, before the repeal of that section
178178 by this Act, continues to be valid until the license expires, and
179179 former Section 1001.253, Education Code, is continued in effect for
180180 that purpose.
181181 (c) A person who holds on the effective date of this Act a
182182 driver education instructor license described by former Section
183183 1001.253(b), Education Code, is entitled on expiration of that
184184 license to issuance of a driver education instructor license
185185 certified as a teaching assistant under Section 1001.2532,
186186 Education Code, as added by this Act, if the person otherwise meets
187187 the requirements for renewal of a driver education instructor
188188 license certified as a teaching assistant.
189189 (d) A person who holds on the effective date of this Act a
190190 driver education instructor license described by former Section
191191 1001.253(c), Education Code, is entitled on expiration of that
192192 license to issuance of a driver education instructor license
193193 certified as a driver education teacher under Section 1001.2533,
194194 Education Code, as added by this Act, if the person otherwise meets
195195 the requirements for renewal of a driver education instructor
196196 license certified as a driver education teacher.
197197 (e) A person who holds on the effective date of this Act a
198198 driver education instructor license described by former Section
199199 1001.253(e), Education Code, is entitled on expiration of that
200200 license to issuance of a driver education instructor license
201201 certified as a supervising teacher under Section 1001.2534,
202202 Education Code, as added by this Act, if the person otherwise meets
203203 the requirements for renewal of a driver education instructor
204204 license certified as a supervising teacher.
205205 (f) The changes in law made by this Act do not affect the
206206 validity of a disciplinary action or other proceeding that was
207207 initiated before the effective date of this Act and that is pending
208208 before a court or other governmental entity on the effective date of
209209 this Act.
210210 (g) Sections 1001.2531, 1001.2532, 1001.2533, 1001.2534,
211211 and 1001.2535, Education Code, as added by this Act, apply only to
212212 an application for, or renewal of, an instructor license submitted
213213 to the Texas Department of Licensing and Regulation on or after the
214214 effective date of this Act. An application submitted before that
215215 date is governed by the law in effect when the application was
216216 submitted, and the former law is continued in effect for that
217217 purpose.
218218 SECTION 8. This Act takes effect September 1, 2019.
