66 AN ACT
77 relating to level of care designations for rural hospitals that
88 provide maternal care.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 241, Health and Safety
1111 Code, is amended by adding Section 241.1831 to read as follows:
1212 Sec. 241.1831. LEVEL OF CARE DESIGNATIONS FOR MATERNAL CARE
1313 IN RURAL HOSPITALS. (a) In this section:
1414 (1) "Rural hospital" means a hospital that has fewer
1515 than 50 beds and:
1616 (A) is:
1717 (i) designated by the Centers for Medicare
1818 and Medicaid Services as a critical access hospital, sole community
1919 hospital, or rural referral center; and
2020 (ii) not located in an area defined by the
2121 federal Office of Management and Budget as a metropolitan
2222 statistical area; or
2323 (B) is located in a county with a population of
2424 not more than 60,000.
2525 (2) "Telemedicine medical service" has the meaning
2626 assigned by Section 111.001, Occupations Code.
2727 (b) A rural hospital must have available at all times for
2828 consultation, either in person or as a telemedicine medical
2929 service, a family medicine physician, an obstetrics and gynecology
3030 physician, or a maternal fetal medicine physician who:
3131 (1) for a rural hospital assigned a Level I level of
3232 care designation:
3333 (A) is licensed by the Texas Medical Board;
3434 (B) has obstetrics training and experience; and
3535 (C) has maternal care and obstetrical surgical
3636 privileges; or
3737 (2) for a rural hospital assigned a Level II level of
3838 care designation:
3939 (A) is licensed by the Texas Medical Board;
4040 (B) has obstetrics training and experience;
4141 (C) has maternal care and obstetrical surgical
4242 privileges; and
4343 (D) is available to provide medical services or
4444 telemedicine medical services to a patient of the hospital not
4545 later than 30 minutes after the time the hospital contacts the
4646 physician.
4747 (c) This section does not affect the authority of a
4848 physician to delegate to a certified registered nurse anesthetist
4949 under Section 157.058, Occupations Code.
5050 (d) The department by rule shall establish a process by
5151 which a rural hospital may appeal its level of care designation to
5252 the department.
5353 (e) Except as specifically provided by this section, a rural
5454 hospital is subject to all other requirements for a level of care
5555 designation under this chapter.
5656 SECTION 2. As soon as practicable after the effective date
5757 of this Act, the Department of State Health Services shall adopt
5858 rules as necessary to implement Section 241.1831, Health and Safety
5959 Code, as added by this Act.
6060 SECTION 3. This Act takes effect September 1, 2019.
