46 AN ACT
57 relating to the status of certain medical residents and fellows as
68 governmental employees for purposes of the Texas Tort Claims Act.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter A, Chapter 101, Civil Practice and
911 Remedies Code, is amended by adding Section 101.004 to read as
1012 follows:
1113 Sec. 101.004. STATUS OF MEDICAL RESIDENTS AND FELLOWS. For
1214 purposes of this chapter, a resident or fellow in a graduate medical
1315 training program for physicians that is sponsored by a governmental
1416 unit, including a medical and dental unit as defined by Section
1517 61.003, Education Code, is considered to be an employee of a
1618 governmental unit regardless of the method or source of payment of
1719 the resident or fellow.
1820 SECTION 2. This Act takes effect immediately if it receives
1921 a vote of two-thirds of all the members elected to each house, as
2022 provided by Section 39, Article III, Texas Constitution. If this
2123 Act does not receive the vote necessary for immediate effect, this
2224 Act takes effect September 1, 2019.
