4	6		AN ACT
5	7		relating to the status of certain medical residents and fellows as
6	8		governmental employees for purposes of the Texas Tort Claims Act.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Subchapter A, Chapter 101, Civil Practice and
9	11		Remedies Code, is amended by adding Section 101.004 to read as
10	12		follows:
11	13		Sec. 101.004. STATUS OF MEDICAL RESIDENTS AND FELLOWS. For
12	14		purposes of this chapter, a resident or fellow in a graduate medical
13	15		training program for physicians that is sponsored by a governmental
14	16		unit, including a medical and dental unit as defined by Section
15	17		61.003, Education Code, is considered to be an employee of a
16	18		governmental unit regardless of the method or source of payment of
17	19		the resident or fellow.
18	20		SECTION 2. This Act takes effect immediately if it receives
19	21		a vote of two-thirds of all the members elected to each house, as
20	22		provided by Section 39, Article III, Texas Constitution. If this
21	23		Act does not receive the vote necessary for immediate effect, this
22	24		Act takes effect September 1, 2019.
