S.B. No. 1755 AN ACT relating to the status of certain medical residents and fellows as governmental employees for purposes of the Texas Tort Claims Act. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 101, Civil Practice and Remedies Code, is amended by adding Section 101.004 to read as follows: Sec. 101.004. STATUS OF MEDICAL RESIDENTS AND FELLOWS. For purposes of this chapter, a resident or fellow in a graduate medical training program for physicians that is sponsored by a governmental unit, including a medical and dental unit as defined by Section 61.003, Education Code, is considered to be an employee of a governmental unit regardless of the method or source of payment of the resident or fellow. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.
