66 AN ACT
77 relating to a mental health professional to school law enforcement
88 official ratio for public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1111 amended by adding Section 37.0816 to read as follows:
1212 Sec. 37.0816. MENTAL HEALTH PROFESSIONAL TO SCHOOL LAW
1313 ENFORCEMENT OFFICIAL RATIOS. (a) In this section:
1414 (1) "Mental health professional" means:
1515 (A) a school counselor certified under
1616 Subchapter B, Chapter 21;
1717 (B) a licensed specialist in school psychology,
1818 as defined by Section 501.002, Occupations Code;
1919 (C) a licensed professional counselor, as
2020 defined by Section 503.002, Occupations Code; or
2121 (D) a licensed clinical social worker, as defined
2222 by Section 505.002, Occupations Code.
2323 (2) "School district peace officer" means a peace
2424 officer commissioned under Section 37.081.
2525 (3) "School law enforcement official" means:
2626 (A) a security officer employed by a school
2727 district or open-enrollment charter school;
2828 (B) a person who provides security services under
2929 a contract with a school district or open-enrollment charter
3030 school;
3131 (C) a school district peace officer; or
3232 (D) a school resource officer who provides a
3333 regular presence on a school district or open-enrollment charter
3434 school campus under a memorandum of understanding between the
3535 district or school and a local law enforcement agency.
3636 (b) A school district or open-enrollment charter school
3737 that employs, commissions, or contracts for the services of a
3838 school law enforcement official to carry out this subchapter shall
3939 maintain a mental health professional to school law enforcement
4040 official ratio that is not less than:
4141 (1) four mental health professionals for each school
4242 law enforcement official if the district or school has a student
4343 enrollment of 5,000 or more students;
4444 (2) three mental health professionals for each school
4545 law enforcement official if the district or school has a student
4646 enrollment of more than 500 and less than 5,000; and
4747 (3) two mental health professionals for each school
4848 law enforcement official if the district or school has a student
4949 enrollment of 500 or less.
5050 (c) A school district or open-enrollment charter school may
5151 apply under Section 7.056 to the commissioner for a waiver of the
5252 ratio requirement imposed under Subsection (b). In addition to the
5353 requirements under Section 7.056(b), a school district or
5454 open-enrollment charter school requesting a waiver shall submit to
5555 the commissioner within the period prescribed by Section 7.056(b)
5656 documentation approved by the board of trustees of the district or
5757 the governing body of the school showing that the district or school
5858 made a good faith but unsuccessful attempt to obtain the applicable
5959 number of mental health professionals required under Subsection
6060 (b).
6161 (c-1) Notwithstanding Subsection (c), a school district or
6262 open-enrollment charter school that applies under Section 7.056(b)
6363 to the commissioner for a waiver of the ratio requirement imposed
6464 under Subsection (b) of this section for the 2019-2020 school year
6565 is not required to submit documentation showing that the district
6666 or school made a good faith but unsuccessful attempt to obtain the
6767 applicable number of mental health professionals required under
6868 Subsection (b). This subsection expires September 1, 2020.
6969 (d) A school district or open-enrollment charter school
7070 that receives a waiver of the ratio requirement imposed under
7171 Subsection (b) shall ensure that each school law enforcement
7272 official complete appropriate training by:
7373 (1) verifying that each school law enforcement
7474 official subject to Section 1701.263, Occupations Code, has
7575 completed the required education and training program; and
7676 (2) for any school law enforcement official who is not
7777 subject to Section 1701.263, Occupations Code, requiring the
7878 official to complete:
7979 (A) the model training curriculum developed
8080 under Section 1701.262, Occupations Code, if the official is a
8181 school district peace officer or school resource officer;
8282 (B) positive behavior interventions and supports
8383 training provided by a regional education service center; or
8484 (C) a school safety course provided by the Texas
8585 School Safety Center under Section 37.205.
8686 SECTION 2. The changes in law made by this Act apply
8787 beginning with the 2019-2020 school year.
8888 SECTION 3. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2019.
