106 AN ACT
117 relating to the dismissal of certain actions relating to Medicaid
128 fraud.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. The heading to Section 36.102, Human Resources
1511 Code, is amended to read as follows:
1612 Sec. 36.102. INITIATION OF ACTION; CONSENT REQUIRED FOR
1713 DISMISSAL.
1814 SECTION 2. Section 36.102(e), Human Resources Code, is
1915 amended to read as follows:
2016 (e) An action under this subchapter may be dismissed [before
2117 the end of the period during which the petition remains under seal]
2218 only if the court and the attorney general consent in writing to the
2319 dismissal and state their reasons for consenting.
2420 SECTION 3. The change in law made by this Act applies only
2521 to an action brought on or after the effective date of this Act. An
2622 action brought before the effective date of this Act is governed by
2723 the law applicable to the action immediately before the effective
2824 date of this Act, and that law is continued in effect for that
2925 purpose.
3026 SECTION 4. This Act takes effect September 1, 2019.
