9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 29.081, Education Code, is amended by |
---|
11 | 11 | | amending Subsection (e-2) and adding Subsection (f-1) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (e-2) An Internet online dropout recovery education program |
---|
14 | 14 | | must: |
---|
15 | 15 | | (1) include as a part of its curriculum credentials, |
---|
16 | 16 | | certifications, or other course offerings that relate directly to |
---|
17 | 17 | | employment opportunities in the state; |
---|
18 | 18 | | (2) employ as faculty and administrators persons with |
---|
19 | 19 | | baccalaureate or advanced degrees; |
---|
20 | 20 | | (3) provide an academic coach and local advocate for |
---|
21 | 21 | | each student; |
---|
22 | 22 | | (4) use an individual learning plan to monitor each |
---|
23 | 23 | | student's progress; |
---|
24 | 24 | | (5) [establish satisfactory requirements for the |
---|
25 | 25 | | monthly progress of students according to standards set by the |
---|
26 | 26 | | commissioner; |
---|
27 | 27 | | [(6)] provide a monthly report to the student's school |
---|
28 | 28 | | district regarding the student's progress; |
---|
29 | 29 | | (6) [(7)] perform satisfactorily according to |
---|
30 | 30 | | performance indicators and accountability standards adopted for |
---|
31 | 31 | | alternative education programs by the commissioner; and |
---|
32 | 32 | | (7) [(8)] comply with this title and rules adopted |
---|
33 | 33 | | under this title except as otherwise provided by this subsection. |
---|
34 | 34 | | (f-1) An Internet online dropout recovery education program |
---|
35 | 35 | | is not subject to commissioner rules applicable to an optional |
---|
36 | 36 | | flexible school day program under Section 29.0822 regarding minutes |
---|
37 | 37 | | of instruction and calculation of average daily attendance. For |
---|
38 | 38 | | the purposes of calculating attendance for an Internet online |
---|
39 | 39 | | dropout recovery education program, the commissioner shall: |
---|
40 | 40 | | (1) consider a student to be scheduled for and |
---|
41 | 41 | | receiving instruction for 55 minutes per day for each course taken |
---|
42 | 42 | | for purposes of determining whether the student satisfies the |
---|
43 | 43 | | requirements of half-day or full-day enrollment; |
---|
44 | 44 | | (2) consider a student who is enrolled for five |
---|
45 | 45 | | semester courses to be in attendance for each day of instruction in |
---|
46 | 46 | | the reporting period for purposes of establishing the student's |
---|
47 | 47 | | daily attendance; |
---|
48 | 48 | | (3) calculate the final average daily attendance of |
---|
49 | 49 | | the program based on successful student completion of semester |
---|
50 | 50 | | courses in which students were enrolled using course completion |
---|
51 | 51 | | data reported by the district; |
---|
52 | 52 | | (4) adjust the average daily attendance based on |
---|
53 | 53 | | students' failure to complete semester courses; and |
---|
54 | 54 | | (5) adjust the amount of funding provided under the |
---|
55 | 55 | | Foundation School Program during the following school year based on |
---|
56 | 56 | | any adjustment made under Subdivision (4). |
---|
57 | 57 | | SECTION 2. This Act takes effect September 1, 2019. |
