| 6 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 9 | | SECTION 1. Section 14A.001(1), Agriculture Code, is amended |
|---|
| 8 | 10 | | to read as follows: |
|---|
| 9 | 11 | | (1) "Public warehouse operator" means a person who |
|---|
| 10 | 12 | | stores cotton, wheat, rye, oats, grapes, or rice, or any kind of |
|---|
| 11 | 13 | | produce. |
|---|
| 12 | 14 | | SECTION 2. Chapter 14A, Agriculture Code, is amended by |
|---|
| 13 | 15 | | adding Sections 14A.0065 and 14A.0115 to read as follows: |
|---|
| 14 | 16 | | Sec. 14A.0065. RECEIPT FOR GRAPES. (a) A public warehouse |
|---|
| 15 | 17 | | operator shall issue a warehouse receipt to any person who deposits |
|---|
| 16 | 18 | | grapes in the warehouse operator's warehouse and requests a |
|---|
| 17 | 19 | | receipt. |
|---|
| 18 | 20 | | (b) The receipt shall contain: |
|---|
| 19 | 21 | | (1) all information required to be included on a |
|---|
| 20 | 22 | | receipt by Section 14A.005; |
|---|
| 21 | 23 | | (2) the date on which the grapes were received in the |
|---|
| 22 | 24 | | warehouse; |
|---|
| 23 | 25 | | (3) a statement that the grapes represented by the |
|---|
| 24 | 26 | | receipt are deliverable on return of the receipt properly endorsed |
|---|
| 25 | 27 | | and payment of charges for storage and insurance stated on the face |
|---|
| 26 | 28 | | of the receipt; and |
|---|
| 27 | 29 | | (4) a statement of the varietal of the grapes |
|---|
| 28 | 30 | | represented by the receipt. |
|---|
| 29 | 31 | | (c) Failure or neglect by a public warehouse operator to |
|---|
| 30 | 32 | | comply with the provisions of this section is a ground for |
|---|
| 31 | 33 | | revocation of a certificate to transact business as a public |
|---|
| 32 | 34 | | warehouse operator. |
|---|
| 33 | 35 | | Sec. 14A.0115. GRAPE BYPRODUCTS. Notwithstanding any other |
|---|
| 34 | 36 | | law, a natural byproduct of grapes stored in a public warehouse |
|---|
| 35 | 37 | | operator's warehouse is an agricultural commodity and not subject |
|---|
| 36 | 38 | | to regulation under other law, regardless of the byproduct's |
|---|
| 37 | 39 | | alcohol content, until the byproduct is: |
|---|
| 38 | 40 | | (1) removed from the warehouse; or |
|---|
| 39 | 41 | | (2) mixed with another ingredient. |
|---|
| 40 | 42 | | SECTION 3. Section 14A.012, Agriculture Code, is amended by |
|---|
| 41 | 43 | | adding Subsection (c) to read as follows: |
|---|
| 42 | 44 | | (c) This chapter does not apply to a producer of grapes who |
|---|
| 43 | 45 | | stores in a warehouse owned by the producer grapes produced and |
|---|
| 44 | 46 | | owned by the producer. |
|---|
| 45 | 47 | | SECTION 4. This Act takes effect September 1, 2019. |
