57 relating to collecting and reporting by the Department of Family
68 and Protective Services and the Health and Human Services
79 Commission of certain information relating to certain alcohol and
810 controlled substance use and treatment.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 162.007(a), Family Code, is amended to
1113 read as follows:
1214 (a) The health history of the child must include information
1315 about:
1416 (1) the child's health status at the time of placement;
1517 (2) the child's birth, neonatal, and other medical,
1618 psychological, psychiatric, and dental history information,
1719 including to the extent known by the Department of Family and
1820 Protective Services based on the information collected under
1921 Section 264.019 [department]:
2022 (A) whether the child's birth mother consumed
2123 alcohol during pregnancy; and
2224 (B) whether the child has been diagnosed with
2325 fetal alcohol spectrum disorder;
2426 (3) a record of immunizations for the child; and
2527 (4) the available results of medical, psychological,
2628 psychiatric, and dental examinations of the child.
2729 SECTION 2. Subchapter A, Chapter 264, Family Code, is
2830 amended by adding Section 264.019 to read as follows:
2931 Sec. 264.019. COLLECTION AND REPORTING OF ALCOHOL AND
3032 CONTROLLED SUBSTANCE STATISTICS. (a) The department shall
3133 collect the following information and update the department's
3234 automated case tracking and information management system to allow
3335 caseworkers to record:
3436 (1) the number of children reported to the department
3537 who at birth tested positive for the presence of alcohol or a
3638 controlled substance;
3739 (2) the controlled substances for which the children
3840 described by Subdivision (1) tested positive;
3941 (3) the number of children described by Subdivision
4042 (1) who were removed from their homes and have been diagnosed as
4143 having a disability or chronic medical condition resulting from the
4244 presence of alcohol or controlled substances; and
4345 (4) the number of parents who test positive for the
4446 presence of a controlled substance during a department
4547 investigation of a report of abuse or neglect of the parent's child.
4648 (b) Not later than November 1 of each year, the department
4749 shall:
4850 (1) prepare for the preceding year a report
4951 containing:
5052 (A) the information collected under Subsection
5153 (a); and
5254 (B) the data collected under Section 531.02143,
5355 Government Code;
5456 (2) post a copy of the report prepared under
5557 Subdivision (1) on the department's Internet website; and
5658 (3) electronically submit to the legislature a copy of
5759 the report.
5860 (c) The commissioner of the department shall adopt rules
5961 necessary to implement this section.
6062 (d) The department is required to implement this section in
6163 a state fiscal biennium only if the commissioner of the department
6264 determines that the legislature has specifically appropriated an
6365 amount sufficient to update the department's automated case
6466 tracking and information management system. If the commissioner of
6567 the department does not make that determination, the department
6668 shall implement this section not later than the date of the
6769 department's next update of the automated case tracking and
6870 information management system.
6971 SECTION 3. Subchapter B, Chapter 531, Government Code, is
7072 amended by adding Section 531.02143 to read as follows:
7173 Sec. 531.02143. DATA REGARDING POSTNATAL ALCOHOL AND
7274 CONTROLLED SUBSTANCE TREATMENT. (a) The commission shall collect
7375 hospital discharge data for Medicaid recipients regarding
7476 treatment of a newborn child for prenatal exposure to alcohol or a
7577 controlled substance.
7678 (b) The commission shall provide the data collected under
7779 Subsection (a) to the Department of Family and Protective Services.
7880 SECTION 4. This Act takes effect January 1, 2020.
