 A BILL TO BE ENTITLED
 AN ACT
 relating to a prohibition on the application of certain pesticides
 at public school buildings and other facilities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 1951.212(c), Occupations Code, is
 amended to read as follows:
 (c)  The department shall include in standards adopted under
 this section a:
 (1)  requirement to use the least toxic methods
 available to control pests, rodents, insects, and weeds; and
 (2)  prohibition on the application of glyphosate or a
 neonicotinoid pesticide at a school building or other school
 district facility.
 SECTION 2.  The Department of Agriculture shall adopt
 standards under Section 1951.212(c), Occupations Code, as amended
 by this Act, as soon as practicable after the effective date of this
 Act.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2019.
