| 6 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 9 | | SECTION 1. Section 34.01(2), Penal Code, is amended to read |
|---|
| 8 | 10 | | as follows: |
|---|
| 9 | 11 | | (2) "Funds" includes: |
|---|
| 10 | 12 | | (A) coin or paper money of the United States or |
|---|
| 11 | 13 | | any other country that is designated as legal tender and that |
|---|
| 12 | 14 | | circulates and is customarily used and accepted as a medium of |
|---|
| 13 | 15 | | exchange in the country of issue; |
|---|
| 14 | 16 | | (B) United States silver certificates, United |
|---|
| 15 | 17 | | States Treasury notes, and Federal Reserve System notes; |
|---|
| 16 | 18 | | (C) an official foreign bank note that is |
|---|
| 17 | 19 | | customarily used and accepted as a medium of exchange in a foreign |
|---|
| 18 | 20 | | country and a foreign bank draft; and |
|---|
| 19 | 21 | | (D) currency or its equivalent, including an |
|---|
| 20 | 22 | | electronic fund, a personal check, a bank check, a traveler's |
|---|
| 21 | 23 | | check, a money order, a bearer negotiable instrument, a bearer |
|---|
| 22 | 24 | | investment security, a bearer security, a certificate of stock in a |
|---|
| 23 | 25 | | form that allows title to pass on delivery, [or] a stored value card |
|---|
| 24 | 26 | | as defined by Section 604.001, Business & Commerce Code, or a |
|---|
| 25 | 27 | | digital currency. |
|---|
| 26 | 28 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 29 | | to an offense committed on or after the effective date of this Act. |
|---|
| 28 | 30 | | An offense committed before the effective date of this Act is |
|---|
| 29 | 31 | | governed by the law in effect on the date the offense was committed, |
|---|
| 30 | 32 | | and the former law is continued in effect for that purpose. For |
|---|
| 31 | 33 | | purposes of this section, an offense was committed before the |
|---|
| 32 | 34 | | effective date of this Act if any element of the offense occurred |
|---|
| 33 | 35 | | before that date. |
|---|
| 34 | 36 | | SECTION 3. This Act takes effect September 1, 2019. |
