A BILL TO BE ENTITLED
AN ACT
relating to restrictions on municipal regulation in certain areas.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 229, Local Government Code, is amended
by adding Subchapter Z to read as follows:
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
Sec. 229.901. RESTRICTION ON MUNICIPAL REGULATION IN
CERTAIN AREAS. Notwithstanding any other law, in an area in which
the residents are ineligible or have only limited eligibility to
vote in municipal elections, a municipality may not regulate an
activity or structure that is regulated by this state.
SECTION 2. This Act takes effect September 1, 2019.
