411 A BILL TO BE ENTITLED
512 AN ACT
6- relating to a border operations training program for peace officers
13+ relating to a border volunteer training program for peace officers
714 employed by local law enforcement agencies.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1017 amended by adding Section 411.02096 to read as follows:
11- Sec. 411.02096. BORDER OPERATIONS TRAINING PROGRAM;
18+ Sec. 411.02096. BORDER VOLUNTEER TRAINING PROGRAM;
1219 COMMISSION. (a) The department, in coordination with local law
1320 enforcement agencies, shall establish and administer a border
14- operations training program for peace officers employed by local
15- law enforcement agencies that will prepare the officers to:
21+ volunteer training program for peace officers employed by local law
22+ enforcement agencies that will prepare the officers to:
1623 (1) collaborate and cooperate with and assist any law
1724 enforcement agency in the interdiction, investigation, and
1825 prosecution of criminal activity in the Texas-Mexico border region;
1926 and
2027 (2) collaborate and cooperate with and assist district
2128 attorneys, county attorneys, the border prosecution unit, and other
2229 prosecutors in the investigation and prosecution of allegations of
2330 criminal activity in the Texas-Mexico border region.
2431 (b) The training program under Subsection (a) must include:
25- (1) information on:
26- (A) criminal activity occurring along the
27- Texas-Mexico border, including drug trafficking and trafficking of
28- persons and other activity carried out by cartels, transnational
29- gangs, and other groups engaged in organized criminal activity; and
30- (B) methods for identifying northbound,
31- southbound, and intrastate criminal activity associated with drug
32- trafficking, trafficking of persons, and other organized criminal
32+ (1) information on criminal activity occurring along
33+ the Texas-Mexico border, including drug trafficking and
34+ trafficking of persons and other activity carried out by cartels,
35+ transnational gangs, and other groups engaged in organized criminal
3336 activity;
3437 (2) best practices for investigating and prosecuting
3538 the criminal activity described by Subdivision (1) and securing the
3639 Texas-Mexico border; and
3740 (3) an overview of the department's operations at the
3841 Texas-Mexico border, including any collaboration with the United
3942 States Customs and Border Protection.
40- (c) The department shall identify opportunities for a peace
41- officer described by Subsection (a) to assist in the department's
42- duties related to border operations. The department may authorize
43- the officer to assist in carrying out those duties.
44- (d) A peace officer authorized by the department to assist
45- in carrying out duties related to the department's border
46- operations as described by Subsection (c) is not entitled to
47- compensation from the department for the assistance provided.
48- (e) The department may partner with federal agencies in
49- administering the training program under Subsection (a) and
50- facilitating any assistance provided by a peace officer under
51- Subsection (c).
43+ (c) If a peace officer described by Subsection (a)
44+ successfully completes the training program under this section and
45+ volunteers to assist the department and the United States Customs
46+ and Border Protection with securing the Texas-Mexico border, the
47+ department may:
48+ (1) commission the officer as an officer of the
49+ department; and
50+ (2) deploy the officer to assist the department and,
51+ as applicable, the United States Customs and Border Protection, in
52+ securing the Texas-Mexico border.
53+ (d) A commission under Subsection (c) expires as determined
54+ by the department. The department is not required to comply with
55+ Section 1701.303, Occupations Code, with respect to a peace officer
56+ commissioned under Subsection (c).
57+ (e) A volunteer peace officer deployed by the department
58+ under Subsection (c) is not entitled to compensation for the
59+ assistance provided.
5260 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
5361 amended by adding Section 1701.359 to read as follows:
54- Sec. 1701.359. BORDER OPERATIONS TRAINING PROGRAM. The
62+ Sec. 1701.359. BORDER VOLUNTEER TRAINING PROGRAM. The
5563 commission may:
5664 (1) recognize, or with the consent of the Department
57- of Public Safety administer or assist in administering, the border
58- operations training program established under Section 411.02096,
59- Government Code, as a continuing education program for officers;
60- and
65+ of Public Safety administer, the border volunteer training program
66+ established under Section 411.02096, Government Code, as a
67+ continuing education program for officers; and
6168 (2) credit an officer who successfully completes the
6269 program described by Subdivision (1) with the appropriate number of
6370 continuing education hours.
6471 SECTION 3. This Act takes effect September 1, 2019.
