8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Sections 12.104(b-2) and (b-3), Education Code, |
---|
10 | 12 | | are amended to read as follows: |
---|
11 | 13 | | (b-2) An open-enrollment charter school is subject to the |
---|
12 | 14 | | requirement to establish an individual graduation committee under |
---|
13 | 15 | | Section 28.0258. This subsection expires September 1, 2023 [2019]. |
---|
14 | 16 | | (b-3) An open-enrollment charter school is subject to the |
---|
15 | 17 | | graduation qualification procedure established by the commissioner |
---|
16 | 18 | | under Section 28.02541. This subsection expires September 1, 2023 |
---|

18 | 20 | | SECTION 2. Section 28.025(c-6), Education Code, is amended |

28 | 30 | | (2) successfully completed the curriculum |

29 | 31 | | requirements for high school graduation applicable to the student |
---|
30 | 32 | | when the student entered the ninth grade; |
---|
31 | 33 | | (3) has not performed satisfactorily on an assessment |
---|
32 | 34 | | instrument or a part of an assessment instrument required for high |
---|
33 | 35 | | school graduation, including an alternate assessment instrument |
---|
34 | 36 | | offered under Section 39.025(c-2) [39.025(c-1)]; and |
---|
35 | 37 | | (4) has been administered the assessment instrument or |
---|
36 | 38 | | the part of the assessment instrument for which the student has not |
---|
37 | 39 | | performed satisfactorily at least three times. |

56 | 58 | | (2) enrolls in an associate degree or certificate |
---|
57 | 59 | | program at a public or private institution of higher education; |
---|
58 | 60 | | (3) enrolls in a bachelor's degree program at a public |
---|
59 | 61 | | or private institution of higher education; or |
---|
60 | 62 | | (4) enlists in the armed forces of the United States or |
---|
61 | 63 | | the Texas National Guard. |

62 | 64 | | SECTION 8. Subsection (a-2), Section 39.025, Education |
---|
63 | 65 | | Code, as added by Chapter 5 (S.B. 149), Acts of the 84th |
---|
64 | 66 | | Legislature, Regular Session, 2015, is redesignated as Subsection |
---|
65 | 67 | | (a-5), Section 39.025, Education Code, and amended to read as |

67 | 69 | | (a-5) [(a-2)] Notwithstanding Subsection (a), a student who |

68 | 70 | | has failed to perform satisfactorily on end-of-course assessment |
---|
69 | 71 | | instruments in the manner provided under this section may receive a |

70 | 72 | | high school diploma if the student has qualified for graduation |
---|
71 | 73 | | under Section 28.0258. This subsection expires September 1, 2023 |

73 | 75 | | SECTION 9. Section 39.025(a-3), Education Code, is amended |

74 | 76 | | to read as follows: |

75 | 77 | | (a-3) A student who, after retaking an end-of-course |

76 | 78 | | assessment instrument for Algebra I or English II, has failed to |
---|
77 | 79 | | perform satisfactorily as required by Subsection (a), but who |

78 | 80 | | receives a score of proficient on the Texas Success Initiative |

79 | 81 | | (TSI) diagnostic assessment for the corresponding subject for which |
---|
80 | 82 | | the student failed to perform satisfactorily on the end-of-course |

81 | 83 | | assessment instrument satisfies the requirement concerning the |
---|
82 | 84 | | Algebra I or English II end-of-course assessment, as applicable. |
---|
83 | 85 | | This subsection expires September 1, 2023 [2019]. |

84 | 86 | | SECTION 10. Except as otherwise provided by this Act, this |
---|
85 | 87 | | Act takes effect immediately if it receives a vote of two-thirds of |
---|
86 | 88 | | all the members elected to each house, as provided by Section 39, |
---|
87 | 89 | | Article III, Texas Constitution. If this Act does not receive the |
---|
88 | 90 | | vote necessary for immediate effect, this Act takes effect on the |
---|
89 | 91 | | 91st day after the last day of the legislative session. |
