46 AN ACT
57 relating to the use of individual graduation committees and other
68 alternative methods to satisfy certain public high school
79 graduation requirements.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Sections 12.104(b-2) and (b-3), Education Code,
1012 are amended to read as follows:
1113 (b-2) An open-enrollment charter school is subject to the
1214 requirement to establish an individual graduation committee under
1315 Section 28.0258. This subsection expires September 1, 2023 [2019].
1416 (b-3) An open-enrollment charter school is subject to the
1517 graduation qualification procedure established by the commissioner
1618 under Section 28.02541. This subsection expires September 1, 2023
1719 [2019].
1820 SECTION 2. Section 28.025(c-6), Education Code, is amended
1921 to read as follows:
2022 (c-6) Notwithstanding Subsection (c), a person may receive
2123 a diploma if the person is eligible for a diploma under Section
2224 28.0258. This subsection expires September 1, 2023 [2019].
2325 SECTION 3. Effective September 1, 2019, Section
2426 28.02541(a), Education Code, is amended to read as follows:
2527 (a) This section applies only to a student who:
2628 (1) entered the ninth grade before the 2011-2012
2729 school year;
2830 (2) successfully completed the curriculum
2931 requirements for high school graduation applicable to the student
3032 when the student entered the ninth grade;
3133 (3) has not performed satisfactorily on an assessment
3234 instrument or a part of an assessment instrument required for high
3335 school graduation, including an alternate assessment instrument
3436 offered under Section 39.025(c-2) [39.025(c-1)]; and
3537 (4) has been administered the assessment instrument or
3638 the part of the assessment instrument for which the student has not
3739 performed satisfactorily at least three times.
3840 SECTION 4. Section 28.02541(g), Education Code, is amended
3941 to read as follows:
4042 (g) This section expires September 1, 2023 [2019].
4143 SECTION 5. Section 28.0258(l), Education Code, is amended
4244 to read as follows:
4345 (l) This section expires September 1, 2023 [2019].
4446 SECTION 6. Section 28.0259(e), Education Code, is amended
4547 to read as follows:
4648 (e) This section expires September 1, 2023 [2019].
4749 SECTION 7. Section 28.02591(a), Education Code, is amended
4850 to read as follows:
4951 (a) The Texas Higher Education Coordinating Board, in
5052 coordination with the agency, shall collect longitudinal data
5153 relating to the post-graduation pursuits of each student who is
5254 awarded a diploma based on the determination of an individual
5355 graduation committee under Section 28.0258, as that section existed
5456 before September 1, 2023 [2019], including whether the student:
5557 (1) enters the workforce;
5658 (2) enrolls in an associate degree or certificate
5759 program at a public or private institution of higher education;
5860 (3) enrolls in a bachelor's degree program at a public
5961 or private institution of higher education; or
6062 (4) enlists in the armed forces of the United States or
6163 the Texas National Guard.
6264 SECTION 8. Subsection (a-2), Section 39.025, Education
6365 Code, as added by Chapter 5 (S.B. 149), Acts of the 84th
6466 Legislature, Regular Session, 2015, is redesignated as Subsection
6567 (a-5), Section 39.025, Education Code, and amended to read as
6668 follows:
6769 (a-5) [(a-2)] Notwithstanding Subsection (a), a student who
6870 has failed to perform satisfactorily on end-of-course assessment
6971 instruments in the manner provided under this section may receive a
7072 high school diploma if the student has qualified for graduation
7173 under Section 28.0258. This subsection expires September 1, 2023
7274 [2019].
7375 SECTION 9. Section 39.025(a-3), Education Code, is amended
7476 to read as follows:
7577 (a-3) A student who, after retaking an end-of-course
7678 assessment instrument for Algebra I or English II, has failed to
7779 perform satisfactorily as required by Subsection (a), but who
7880 receives a score of proficient on the Texas Success Initiative
7981 (TSI) diagnostic assessment for the corresponding subject for which
8082 the student failed to perform satisfactorily on the end-of-course
8183 assessment instrument satisfies the requirement concerning the
8284 Algebra I or English II end-of-course assessment, as applicable.
8385 This subsection expires September 1, 2023 [2019].
8486 SECTION 10. Except as otherwise provided by this Act, this
8587 Act takes effect immediately if it receives a vote of two-thirds of
8688 all the members elected to each house, as provided by Section 39,
8789 Article III, Texas Constitution. If this Act does not receive the
8890 vote necessary for immediate effect, this Act takes effect on the
8991 91st day after the last day of the legislative session.
