46 AN ACT
57 relating to the provision of information to certain women enrolled
68 in the Healthy Texas Women program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter B, Chapter 531, Government Code, is
911 amended by adding Section 531.0995 to read as follows:
1012 Sec. 531.0995. INFORMATION FOR CERTAIN ENROLLEES IN THE
1113 HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas
1214 Women program" means a program operated by the commission that is
1315 substantially similar to the demonstration project operated under
1416 former Section 32.0248, Human Resources Code, and that is intended
1517 to expand access to preventive health and family planning services
1618 for women in this state.
1719 (b) This section applies to a woman who is automatically
1820 enrolled in the Healthy Texas Women program following a pregnancy
1921 for which the woman received Medicaid, but who is no longer eligible
2022 to participate in Medicaid.
2123 (c) After a woman described by Subsection (b) is enrolled in
2224 the Healthy Texas Women program, the commission shall provide to
2325 the woman:
2426 (1) information about the Healthy Texas Women program,
2527 including the services provided under the program; and
2628 (2) a list of health care providers who participate in
2729 the Healthy Texas Women program and are located in the same
2830 geographical area in which the woman resides.
2931 (d) The commission shall consult with the Maternal
3032 Mortality and Morbidity Task Force established under Chapter 34,
3133 Health and Safety Code, to improve the process for providing the
3234 information required by Subsection (c), including by determining:
3335 (1) the best time for providing the information; and
3436 (2) the manner by which the information should be
3537 provided, including the information about health care providers
3638 described by Subsection (c)(2).
3739 SECTION 2. As soon as practicable after the effective date
3840 of this Act, the executive commissioner of the Health and Human
3941 Services Commission shall adopt any rules necessary to implement
4042 Section 531.0995, Government Code, as added by this Act.
4143 SECTION 3. Section 531.0995, Government Code, as added by
4244 this Act, applies only to a woman automatically enrolled in the
4345 Healthy Texas Women program on or after January 1, 2020.
4446 SECTION 4. This Act takes effect immediately if it receives
4547 a vote of two-thirds of all the members elected to each house, as
4648 provided by Section 39, Article III, Texas Constitution. If this
4749 Act does not receive the vote necessary for immediate effect, this
4850 Act takes effect September 1, 2019.
