7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
9 | 11 | | amended by adding Section 531.0995 to read as follows: |
---|
10 | 12 | | Sec. 531.0995. INFORMATION FOR CERTAIN ENROLLEES IN THE |
---|
11 | 13 | | HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas |
---|
12 | 14 | | Women program" means a program operated by the commission that is |
---|
13 | 15 | | substantially similar to the demonstration project operated under |
---|
14 | 16 | | former Section 32.0248, Human Resources Code, and that is intended |
---|
15 | 17 | | to expand access to preventive health and family planning services |
---|
16 | 18 | | for women in this state. |
---|
17 | 19 | | (b) This section applies to a woman who is automatically |
---|
18 | 20 | | enrolled in the Healthy Texas Women program following a pregnancy |
---|
19 | 21 | | for which the woman received Medicaid, but who is no longer eligible |
---|
20 | 22 | | to participate in Medicaid. |
---|
21 | 23 | | (c) After a woman described by Subsection (b) is enrolled in |
---|
22 | 24 | | the Healthy Texas Women program, the commission shall provide to |
---|
23 | 25 | | the woman: |
---|
24 | 26 | | (1) information about the Healthy Texas Women program, |
---|
25 | 27 | | including the services provided under the program; and |
---|
26 | 28 | | (2) a list of health care providers who participate in |
---|
27 | 29 | | the Healthy Texas Women program and are located in the same |
---|
28 | 30 | | geographical area in which the woman resides. |
---|
29 | 31 | | (d) The commission shall consult with the Maternal |
---|
30 | 32 | | Mortality and Morbidity Task Force established under Chapter 34, |
---|
31 | 33 | | Health and Safety Code, to improve the process for providing the |
---|
32 | 34 | | information required by Subsection (c), including by determining: |
---|
33 | 35 | | (1) the best time for providing the information; and |
---|
34 | 36 | | (2) the manner by which the information should be |
---|
35 | 37 | | provided, including the information about health care providers |
---|
36 | 38 | | described by Subsection (c)(2). |
---|
37 | 39 | | SECTION 2. As soon as practicable after the effective date |
---|
38 | 40 | | of this Act, the executive commissioner of the Health and Human |
---|
39 | 41 | | Services Commission shall adopt any rules necessary to implement |
---|
40 | 42 | | Section 531.0995, Government Code, as added by this Act. |
---|
41 | 43 | | SECTION 3. Section 531.0995, Government Code, as added by |
---|
42 | 44 | | this Act, applies only to a woman automatically enrolled in the |
---|
43 | 45 | | Healthy Texas Women program on or after January 1, 2020. |
---|
44 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
---|
45 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 50 | | Act takes effect September 1, 2019. |
