5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the development and operation of an aerial cable car or
68 aerial tramway by a regional mobility authority created by a
79 municipality.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Sections 370.003(8) and (14), Transportation
1012 Code, are amended to read as follows:
1113 (8) "Governmental entity" means a political
1214 subdivision of the state, including a municipality or a county, a
1315 political subdivision of a county, a group of adjoining counties, a
1416 district organized or operating under Section 52, Article III, or
1517 Section 59, Article XVI, Texas Constitution, the department or
1618 another state agency, a rail district, a transit authority, a
1719 nonprofit corporation, including a transportation corporation,
1820 that is created under Chapter 431, or any other public entity or
1921 instrumentality.
2022 (14) "Transportation project" means:
2123 (A) a turnpike project;
2224 (B) a system;
2325 (C) a passenger or freight rail facility,
2426 including:
2527 (i) tracks;
2628 (ii) a rail line;
2729 (iii) switching, signaling, or other
2830 operating equipment;
2931 (iv) a depot;
3032 (v) a locomotive;
3133 (vi) rolling stock;
3234 (vii) a maintenance facility; and
3335 (viii) other real and personal property
3436 associated with a rail operation;
3537 (D) a roadway with a functional classification
3638 greater than a local road or rural minor collector;
3739 (D-1) a bridge;
3840 (E) a ferry;
3941 (F) an airport, other than an airport that on
4042 September 1, 2005, was served by one or more air carriers engaged in
4143 scheduled interstate transportation, as those terms were defined by
4244 14 C.F.R. Section 1.1 on that date;
4345 (G) a pedestrian or bicycle facility;
4446 (H) an intermodal hub;
4547 (I) an automated conveyor belt for the movement
4648 of freight;
4749 (J) a border crossing inspection station,
4850 including:
4951 (i) a border crossing inspection station
5052 located at or near an international border crossing; and
5153 (ii) a border crossing inspection station
5254 located at or near a border crossing from another state of the
5355 United States and not more than 50 miles from an international
5456 border;
5557 (K) an air quality improvement initiative;
5658 (L) a public utility facility;
5759 (M) a transit system;
5860 (M-1) a parking area, structure, or facility, or
5961 a collection device for parking fees;
6062 (N) if applicable, projects and programs listed
6163 in the most recently approved state implementation plan for the
6264 area covered by the authority, including an early action compact;
6365 (O) improvements in a transportation
6466 reinvestment zone designated under Subchapter E, Chapter 222; [and]
6567 (P) port security, transportation, or facility
6668 projects eligible for funding under Section 55.002; and
6769 (Q) an aerial cable car or aerial tramway for the
6870 transportation of persons or property, or both, that is located in
6971 the jurisdiction of an authority created under Section 370.031(c).
7072 SECTION 2. The heading to Section 370.303, Transportation
7173 Code, is amended to read as follows:
7274 Sec. 370.303. AGREEMENTS BETWEEN AUTHORITY AND [LOCAL]
7375 GOVERNMENTAL ENTITIES.
7476 SECTION 3. Section 370.303(b-1), Transportation Code, is
7577 amended to read as follows:
7678 (b-1) An agreement under Subsection (a) or (b) may include a
7779 means for a [local] governmental entity to pledge or otherwise
7880 provide funds for a transportation project that benefits the
7981 governmental entity to be developed by the authority.
8082 SECTION 4. This Act takes effect immediately if it receives
8183 a vote of two-thirds of all the members elected to each house, as
8284 provided by Section 39, Article III, Texas Constitution. If this
8385 Act does not receive the vote necessary for immediate effect, this
8486 Act takes effect September 1, 2019.
