| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Sections 370.003(8) and (14), Transportation |
|---|
| 10 | 12 | | Code, are amended to read as follows: |
|---|
| 11 | 13 | | (8) "Governmental entity" means a political |
|---|
| 12 | 14 | | subdivision of the state, including a municipality or a county, a |
|---|
| 13 | 15 | | political subdivision of a county, a group of adjoining counties, a |
|---|
| 14 | 16 | | district organized or operating under Section 52, Article III, or |
|---|
| 15 | 17 | | Section 59, Article XVI, Texas Constitution, the department or |
|---|
| 16 | 18 | | another state agency, a rail district, a transit authority, a |
|---|
| 17 | 19 | | nonprofit corporation, including a transportation corporation, |
|---|
| 18 | 20 | | that is created under Chapter 431, or any other public entity or |
|---|
| 19 | 21 | | instrumentality. |
|---|
| 20 | 22 | | (14) "Transportation project" means: |
|---|
| 21 | 23 | | (A) a turnpike project; |
|---|
| 22 | 24 | | (B) a system; |
|---|
| 23 | 25 | | (C) a passenger or freight rail facility, |
|---|
| 24 | 26 | | including: |
|---|
| 25 | 27 | | (i) tracks; |
|---|
| 26 | 28 | | (ii) a rail line; |
|---|
| 27 | 29 | | (iii) switching, signaling, or other |
|---|
| 28 | 30 | | operating equipment; |
|---|
| 29 | 31 | | (iv) a depot; |
|---|
| 30 | 32 | | (v) a locomotive; |
|---|
| 31 | 33 | | (vi) rolling stock; |
|---|
| 32 | 34 | | (vii) a maintenance facility; and |
|---|
| 33 | 35 | | (viii) other real and personal property |
|---|
| 34 | 36 | | associated with a rail operation; |
|---|
| 35 | 37 | | (D) a roadway with a functional classification |
|---|
| 36 | 38 | | greater than a local road or rural minor collector; |
|---|
| 37 | 39 | | (D-1) a bridge; |

| 65 | 67 | | (P) port security, transportation, or facility |

| 66 | 68 | | projects eligible for funding under Section 55.002; and |

| 67 | 69 | | (Q) an aerial cable car or aerial tramway for the |
|---|
| 68 | 70 | | transportation of persons or property, or both, that is located in |
|---|
| 69 | 71 | | the jurisdiction of an authority created under Section 370.031(c). |

| 70 | 72 | | SECTION 2. The heading to Section 370.303, Transportation |
|---|
| 71 | 73 | | Code, is amended to read as follows: |

| 72 | 74 | | Sec. 370.303. AGREEMENTS BETWEEN AUTHORITY AND [LOCAL] |

| 73 | 75 | | GOVERNMENTAL ENTITIES. |

| 74 | 76 | | SECTION 3. Section 370.303(b-1), Transportation Code, is |

| 75 | 77 | | amended to read as follows: |

| 76 | 78 | | (b-1) An agreement under Subsection (a) or (b) may include a |
|---|
| 77 | 79 | | means for a [local] governmental entity to pledge or otherwise |
|---|
| 78 | 80 | | provide funds for a transportation project that benefits the |
|---|
| 79 | 81 | | governmental entity to be developed by the authority. |
|---|
| 80 | 82 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 81 | 83 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 82 | 84 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 83 | 85 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 84 | 86 | | Act takes effect September 1, 2019. |
