9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 571, Government Code, is | |
11 | 11 | amended by adding Section 571.080 to read as follows: | |
12 | 12 | Sec. 571.080. RANDOM DRUG TESTING OF LEGISLATORS. (a) In | |
13 | 13 | this section, "controlled substance" and "marihuana" have the | |
14 | 14 | meanings assigned by Chapter 481, Health and Safety Code. | |
15 | 15 | (b) The commission by rule shall establish a program to | |
16 | 16 | randomly test members of the legislature for the use of controlled | |
17 | 17 | substances and marihuana during a legislative session. The program | |
18 | 18 | must provide for the random, unannounced drug testing of each | |
19 | 19 | member at times determined by the commission during a legislative | |
20 | 20 | session. The commission shall post on the commission's Internet | |
21 | 21 | website the results of each drug test or, if applicable, a statement | |
22 | 22 | that the member refused to comply with the commission's request for | |
23 | 23 | drug testing. | |
24 | 24 | SECTION 2. Not later than January 1, 2020, the Texas Ethics | |
25 | 25 | Commission shall adopt rules as necessary to implement Section | |
26 | 26 | 571.080, Government Code, as added by this Act. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2019. |
