77 relating to the random drug testing of members of the legislature
88 during a legislative session.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 571, Government Code, is
1111 amended by adding Section 571.080 to read as follows:
1212 Sec. 571.080. RANDOM DRUG TESTING OF LEGISLATORS. (a) In
1313 this section, "controlled substance" and "marihuana" have the
1414 meanings assigned by Chapter 481, Health and Safety Code.
1515 (b) The commission by rule shall establish a program to
1616 randomly test members of the legislature for the use of controlled
1717 substances and marihuana during a legislative session. The program
1818 must provide for the random, unannounced drug testing of each
1919 member at times determined by the commission during a legislative
2020 session. The commission shall post on the commission's Internet
2121 website the results of each drug test or, if applicable, a statement
2222 that the member refused to comply with the commission's request for
2323 drug testing.
2424 SECTION 2. Not later than January 1, 2020, the Texas Ethics
2525 Commission shall adopt rules as necessary to implement Section
2626 571.080, Government Code, as added by this Act.
2727 SECTION 3. This Act takes effect September 1, 2019.
