 A BILL TO BE ENTITLED
 AN ACT
 relating to the random drug testing of members of the legislature
 during a legislative session.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 571, Government Code, is
 amended by adding Section 571.080 to read as follows:
 Sec. 571.080.  RANDOM DRUG TESTING OF LEGISLATORS.  (a) In
 this section, "controlled substance" and "marihuana" have the
 meanings assigned by Chapter 481, Health and Safety Code.
 (b)  The commission by rule shall establish a program to
 randomly test members of the legislature for the use of controlled
 substances and marihuana during a legislative session. The program
 must provide for the random, unannounced drug testing of each
 member at times determined by the commission during a legislative
 session. The commission shall post on the commission's Internet
 website the results of each drug test or, if applicable, a statement
 that the member refused to comply with the commission's request for
 drug testing.
 SECTION 2.  Not later than January 1, 2020, the Texas Ethics
 Commission shall adopt rules as necessary to implement Section
 571.080, Government Code, as added by this Act.
 SECTION 3.  This Act takes effect September 1, 2019.
