9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 38, Penal Code, is amended by adding | |
11 | 11 | Section 38.112 to read as follows: | |
12 | 12 | Sec. 38.112. FAILURE TO COMPLY WITH CONDITION OF PAROLE. | |
13 | 13 | (a) A person who is on parole for an offense listed in Article | |
14 | 14 | 42A.054(a), Code of Criminal Procedure, or for which the judgment | |
15 | 15 | contains an affirmative finding under Article 42A.054(c) or (d), | |
16 | 16 | Code of Criminal Procedure, commits an offense if the person is | |
17 | 17 | required as a condition of release on parole to: | |
18 | 18 | (1) obtain the permission of the Texas Department of | |
19 | 19 | Criminal Justice before changing addresses or provide notice to the | |
20 | 20 | department of the location of the new residence and the person | |
21 | 21 | knowingly fails to obtain the permission or provide the notice as | |
22 | 22 | required; or | |
23 | 23 | (2) report to a parole officer as defined by Section | |
24 | 24 | 508.001, Government Code, and on two consecutive occasions the | |
25 | 25 | person knowingly fails to report as required. | |
26 | 26 | (b) An offense under this section is a state jail felony. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2019. |
