66 AN ACT
77 relating to violations of certain conditions of parole; creating a
88 criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 38, Penal Code, is amended by adding
1111 Section 38.112 to read as follows:
1212 Sec. 38.112. FAILURE TO COMPLY WITH CONDITION OF PAROLE.
1313 (a) A person who is on parole for an offense listed in Article
1414 42A.054(a), Code of Criminal Procedure, or for which the judgment
1515 contains an affirmative finding under Article 42A.054(c) or (d),
1616 Code of Criminal Procedure, commits an offense if the person is
1717 required as a condition of release on parole to:
1818 (1) obtain the permission of the Texas Department of
1919 Criminal Justice before changing addresses or provide notice to the
2020 department of the location of the new residence and the person
2121 knowingly fails to obtain the permission or provide the notice as
2222 required; or
2323 (2) report to a parole officer as defined by Section
2424 508.001, Government Code, and on two consecutive occasions the
2525 person knowingly fails to report as required.
2626 (b) An offense under this section is a state jail felony.
2727 SECTION 2. This Act takes effect September 1, 2019.
