| 7 | 7 | | relating to eliminating resident tuition rates and fees charged to |

| 8 | 8 | | students residing outside of a junior college district. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 130.0032(a) and (c), Education Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (a) The governing board of a junior college district may not |
|---|
| 13 | 13 | | charge tuition and fees to a student who resides outside the |
|---|
| 14 | 14 | | district at a rate that is less than or the same as the rate of |
|---|
| 15 | 15 | | tuition and fees charged to a student who resides in the district |
|---|
| 16 | 16 | | [The governing board of a public junior college district may allow a |
|---|
| 17 | 17 | | person who resides outside the district and who owns property |
|---|
| 18 | 18 | | subject to ad valorem taxation by the district, or a dependent of |
|---|
| 19 | 19 | | the person, to pay tuition at the rate applicable to a student who |
|---|
| 20 | 20 | | resides in the district]. |
|---|
| 21 | 21 | | (c) The governing board of a public junior college district |
|---|
| 22 | 22 | | may allow a person who resides outside the district to pay tuition |
|---|
| 23 | 23 | | and fees at a rate less than the rate applicable to other persons |
|---|
| 24 | 24 | | residing outside the district, but higher [not less] than the rate |
|---|
| 25 | 25 | | applicable to a student who resides in the district, if the person: |
|---|
| 26 | 26 | | (1) resides within the service area of the district; |
|---|
| 27 | 27 | | (2) does not reside in an independent school district |
|---|
| 28 | 28 | | that meets the criteria of the coordinating board for the |
|---|
| 29 | 29 | | establishment of a junior college district under Section 130.013; |
|---|
| 30 | 30 | | and |
|---|
| 31 | 31 | | (3) demonstrates financial need in accordance with |
|---|
| 32 | 32 | | rules adopted by the Texas Higher Education Coordinating Board. |
|---|
| 33 | 33 | | SECTION 2. Sections 130.0032(b) and (b-1), Education Code, |
|---|
| 34 | 34 | | are repealed. |
|---|
| 35 | 35 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 36 | 36 | | 130.0032, Education Code, applies beginning with tuition and fees |
|---|
| 37 | 37 | | charged by a junior college district for the 2020-2021 academic |
|---|
| 38 | 38 | | year. Tuition and fees for a semester or term before that academic |
|---|
| 39 | 39 | | year are covered by the law in effect immediately before the |
|---|
| 40 | 40 | | effective date of this Act, and the former law is continued in |
|---|
| 41 | 41 | | effect for that purpose. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect January 1, 2020. |
