55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eliminating resident tuition rates and fees charged to
88 students residing outside of a junior college district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 130.0032(a) and (c), Education Code,
1111 are amended to read as follows:
1212 (a) The governing board of a junior college district may not
1313 charge tuition and fees to a student who resides outside the
1414 district at a rate that is less than or the same as the rate of
1515 tuition and fees charged to a student who resides in the district
1616 [The governing board of a public junior college district may allow a
1717 person who resides outside the district and who owns property
1818 subject to ad valorem taxation by the district, or a dependent of
1919 the person, to pay tuition at the rate applicable to a student who
2020 resides in the district].
2121 (c) The governing board of a public junior college district
2222 may allow a person who resides outside the district to pay tuition
2323 and fees at a rate less than the rate applicable to other persons
2424 residing outside the district, but higher [not less] than the rate
2525 applicable to a student who resides in the district, if the person:
2626 (1) resides within the service area of the district;
2727 (2) does not reside in an independent school district
2828 that meets the criteria of the coordinating board for the
2929 establishment of a junior college district under Section 130.013;
3030 and
3131 (3) demonstrates financial need in accordance with
3232 rules adopted by the Texas Higher Education Coordinating Board.
3333 SECTION 2. Sections 130.0032(b) and (b-1), Education Code,
3434 are repealed.
3535 SECTION 3. The change in law made by this Act to Section
3636 130.0032, Education Code, applies beginning with tuition and fees
3737 charged by a junior college district for the 2020-2021 academic
3838 year. Tuition and fees for a semester or term before that academic
3939 year are covered by the law in effect immediately before the
4040 effective date of this Act, and the former law is continued in
4141 effect for that purpose.
4242 SECTION 4. This Act takes effect January 1, 2020.
