 A BILL TO BE ENTITLED
 AN ACT
 relating to eliminating resident tuition rates and fees charged to
 students residing outside of a junior college district.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Sections 130.0032(a) and (c), Education Code,
 are amended to read as follows:
 (a)  The governing board of a junior college district may not
 charge tuition and fees to a student who resides outside the
 district at a rate that is less than or the same as the rate of
 tuition and fees charged to a student who resides in the district
 [The governing board of a public junior college district may allow a
 person who resides outside the district and who owns property
 subject to ad valorem taxation by the district, or a dependent of
 the person, to pay tuition at the rate applicable to a student who
 resides in the district].
 (c)  The governing board of a public junior college district
 may allow a person who resides outside the district to pay tuition
 and fees at a rate less than the rate applicable to other persons
 residing outside the district, but higher [not less] than the rate
 applicable to a student who resides in the district, if the person:
 (1)  resides within the service area of the district;
 (2)  does not reside in an independent school district
 that meets the criteria of the coordinating board for the
 establishment of a junior college district under Section 130.013;
 and
 (3)  demonstrates financial need in accordance with
 rules adopted by the Texas Higher Education Coordinating Board.
 SECTION 2.  Sections 130.0032(b) and (b-1), Education Code,
 are repealed.
 SECTION 3.  The change in law made by this Act to Section
 130.0032, Education Code, applies beginning with tuition and fees
 charged by a junior college district for the 2020-2021 academic
 year.  Tuition and fees for a semester or term before that academic
 year are covered by the law in effect immediately before the
 effective date of this Act, and the former law is continued in
 effect for that purpose.
 SECTION 4.  This Act takes effect January 1, 2020.
