96 relating to a prohibition against certain local regulation of

118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Subtitle D, Title 2, Labor Code, is amended by
1310 adding Chapter 83 to read as follows:
1411 CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF CERTAIN
1512 EMPLOYMENT PRACTICES
1613 Sec. 83.001. DEFINITIONS. In this chapter:
1714 (1) "Employee" means an individual who is employed by
1815 an employer for compensation.
1916 (2) "Employer" means a person who employs one or more
2017 employees.
2118 Sec. 83.002. LOCAL REGULATION OF EMPLOYMENT LEAVE
2219 PROHIBITED. (a) A political subdivision of this state may not
2320 adopt or enforce an ordinance, order, rule, regulation, or policy
2421 regulating a private employer's terms of employment relating to any
2522 form of employment leave, including paid days off from work for
2623 holidays, sick leave, vacation, and personal necessity.
2724 (b) An ordinance, order, rule, regulation, or policy that
2825 violates Subsection (a) is void and unenforceable.
29- Sec. 83.003. EFFECT OF CHAPTER. This chapter does not
30- affect:
31- (1) the Texas Minimum Wage Act under Chapter 62; or
32- (2) an ordinance, order, rule, regulation, or policy
33- that prohibits employment discrimination, regardless of whether
34- the ordinance, order, rule, regulation, or policy is adopted
35- before, on, or after September 1, 2019.
3626 SECTION 2. Chapter 83, Labor Code, as added by this Act,
3727 applies to an ordinance, order, rule, regulation, or policy adopted
3828 before, on, or after the effective date of this Act.
3929 SECTION 3. This Act takes effect September 1, 2019.
