57 relating to a disclosure regarding flood coverage under a
68 commercial or residential property insurance policy.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter C, Chapter 2002, Insurance Code, is
911 amended by adding Section 2002.103 to read as follows:
1012 Sec. 2002.103. DISCLOSURE REGARDING FLOOD COVERAGE
1113 REQUIRED. (a) In this section:
1214 (1) "Commercial property insurance" has the meaning
1315 assigned by Section 2301.002, except that the term includes a
1416 commercial multiperil insurance policy that provides commercial
1517 property insurance coverage.
1618 (2) "Residential property insurance" has the meaning
1719 assigned by Section 2301.002, except that the term includes a farm
1820 and ranch insurance policy and a farm and ranch owners insurance
1921 policy.
2022 (b) This section applies to each insurer authorized to
2123 engage in the business of commercial or residential property
2224 insurance in this state, including a county mutual insurance
2325 company, farm mutual insurance company, Lloyd's plan, and
2426 reciprocal or interinsurance exchange.
2527 (c) An insurer that issues or renews a commercial or
2628 residential property insurance policy that does not provide
2729 coverage against loss caused by flooding shall include with the
2830 policy documents provided to the policyholder at the time the
2931 policy is issued or renewed the following statement:
3032 "Flood Insurance: You may also need to consider the purchase
3133 of flood insurance. Your insurance policy does not include
3234 coverage for damage resulting from a flood even if hurricane winds
3335 and rain caused the flood to occur. Without separate flood
3436 insurance coverage, you may have uncovered losses caused by a
3537 flood. Please discuss the need to purchase separate flood
3638 insurance coverage with your insurance agent or insurance company,
3739 or visit www.floodsmart.gov."
3840 (d) The statement described by Subsection (c) must be
3941 conspicuous, as defined by Section 1.201, Business & Commerce Code.
4042 (e) An insurer's failure to comply with this section does
4143 not invalidate any exclusion, including a flood exclusion, in an
4244 insurance policy subject to this section.
4345 SECTION 2. Section 2002.103, Insurance Code, as added by
4446 this Act, applies only to an insurance policy delivered, issued for
4547 delivery, or renewed on or after January 1, 2020. A policy
4648 delivered, issued for delivery, or renewed before January 1, 2020,
4749 is governed by the law as it existed immediately before the
4850 effective date of this Act, and that law is continued in effect for
4951 that purpose.
5052 SECTION 3. This Act takes effect September 1, 2019.
