96 relating to certain duties of county child welfare boards and of the
107 Department of Family and Protective Services regarding county child
118 welfare boards.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 264.005, Family Code, is amended by
1411 amending Subsection (f) and adding Subsections (h), (i), and (j) to
1512 read as follows:
1613 (f) A county child welfare [protective services] board
1714 member may receive information that is confidential under Section
1815 40.005, Human Resources Code, or Section 261.201 when the board
1916 member is acting in the member's official capacity.
2017 (h) The department:
2118 (1) shall identify staff to collaborate with county
2219 child welfare boards to:
2320 (A) coordinate efforts between the department
2421 and the boards in the provision of services; and
2522 (B) maximize the resources of the department and
2623 each board;
2724 (2) may collect publicly available financial
2825 information prepared by a county child welfare board for
2926 distribution to the county commissioners court; and
3027 (3) shall create and make available on the
3128 department's Internet website a standardized form for each county
3229 child welfare board to report:
33- (A) the amount and source of public funds
34- received by the board during the board's preceding fiscal year; and
35- (B) the amount and source of public funds
36- expended by the board during the board's preceding fiscal year,
37- including a description of the purpose of the expenditures.
30+ (A) the amount and source of funds received by
31+ the board during the board's preceding fiscal year; and
32+ (B) the amount and source of funds expended by
33+ the board during the board's preceding fiscal year, including a
34+ description of the purpose of each expenditure.
3835 (i) Not later than November 1 of each year, each county
3936 child welfare board shall report the information described by
4037 Subsection (h)(3) on the form created under that subdivision to:
4138 (1) the department; and
42- (2) the commissioners court for the county or counties
43- in which the board operates.
39+ (2) the commissioner's court for the county or
40+ counties in which the board operates.
4441 (j) Notwithstanding Subsection (i), not later than January
4542 1, 2020, each county child welfare board shall submit the initial
4643 report required by this section. This subsection expires November
4744 1, 2021.
4845 SECTION 2. The Department of Family and Protective Services
4946 shall create and distribute the form required by Section
5047 264.005(h), Family Code, as added by this Act, not later than
5148 November 1, 2019.
5249 SECTION 3. This Act takes effect September 1, 2019.
