8	5		AN ACT
9	6		relating to certain duties of county child welfare boards and of the
10	7		Department of Family and Protective Services regarding county child
11	8		welfare boards.
12	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	10		SECTION 1. Section 264.005, Family Code, is amended by
14	11		amending Subsection (f) and adding Subsections (h), (i), and (j) to
15	12		read as follows:
16	13		(f) A county child welfare [protective services] board
17	14		member may receive information that is confidential under Section
18	15		40.005, Human Resources Code, or Section 261.201 when the board
19	16		member is acting in the member's official capacity.
20	17		(h) The department:
21	18		(1) shall identify staff to collaborate with county
22	19		child welfare boards to:
23	20		(A) coordinate efforts between the department
24	21		and the boards in the provision of services; and
25	22		(B) maximize the resources of the department and
26	23		each board;
27	24		(2) may collect publicly available financial
28	25		information prepared by a county child welfare board for
29	26		distribution to the county commissioners court; and
30	27		(3) shall create and make available on the
31	28		department's Internet website a standardized form for each county
32	29		child welfare board to report:
33		-	(A) the amount and source of ~~public funds~~
34		-	~~received by~~ the board during the board's preceding fiscal year; and
35		-	(B) the amount and source of ~~public funds~~
36		-	~~expended by~~ the board during the board's preceding fiscal year,
37		-	~~including a~~ description of the purpose of ~~the expenditures~~.
	30	+	(A) the amount and source of funds received by
	31	+	the board during the board's preceding fiscal year; and
	32	+	(B) the amount and source of funds expended by
	33	+	the board during the board's preceding fiscal year, including a
	34	+	description of the purpose of each expenditure.
38	35		(i) Not later than November 1 of each year, each county
39	36		child welfare board shall report the information described by
40	37		Subsection (h)(3) on the form created under that subdivision to:
41	38		(1) the department; and
42		-	(2) the ~~commissioners~~ court for the county or ~~counties~~
43		-	in which the board operates.
	39	+	(2) the commissioner's court for the county or
	40	+	counties in which the board operates.
44	41		(j) Notwithstanding Subsection (i), not later than January
45	42		1, 2020, each county child welfare board shall submit the initial
46	43		report required by this section. This subsection expires November
47	44		1, 2021.
48	45		SECTION 2. The Department of Family and Protective Services
49	46		shall create and distribute the form required by Section
50	47		264.005(h), Family Code, as added by this Act, not later than
51	48		November 1, 2019.
52	49		SECTION 3. This Act takes effect September 1, 2019.
