46 AN ACT
57 relating to use of the electronic funds transfer system operated by
68 the comptroller.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 403.016, Government Code, is amended by
911 amending Subsections (b), (c), and (f) and adding Subsections (f-1)
1012 and (f-2) to read as follows:
1113 (b) The comptroller shall use the electronic funds transfer
1214 system to pay an employee's net state salary and travel expense
1315 reimbursements [unless:
1416 [(1) the employee does not hold a classified position
1517 under the state's position classification plan and the employee's
1618 gross state salary is less than the gross state salary for a
1719 position classified to group 8, step 1, of the state position
1820 classification plan; or
1921 [(2) the employee holds a classified position under the
2022 state's position classification plan that is classified below group
2123 8].
2224 (c) The comptroller shall use the electronic funds transfer
2325 system to make:
2426 (1) payments of more than $100 to annuitants by the
2527 Employees Retirement System of Texas, [or] the Teacher Retirement
2628 System of Texas, or the Texas Emergency Services Retirement System
2729 under each [either] system's administrative jurisdiction;
2830 (2) recurring payments to municipalities, counties,
2931 political subdivisions, special districts, and other governmental
3032 entities of this state; and
3133 (3) payments to vendors who choose to receive payment
3234 through the electronic funds transfer system rather than by
3335 warrant.
3436 (f) [(1)] Except as provided by Subsection (f-1)
3537 [Subdivisions (2) and (4)] and subject to any limitation in rules
3638 adopted by the comptroller, an automated clearinghouse, or the
3739 federal government, the comptroller may use the electronic funds
3840 transfer system to deposit payments only to one or more accounts of
3941 a payee at one or more financial institutions, including credit
4042 unions.
4143 (f-1) [(2)] The comptroller may also use the electronic
4244 funds transfer system to deposit the amount [a portion] of an
4345 employee's payroll deduction made as authorized by law [gross pay
4446 into the employee's account at a credit union as prescribed by
4547 Subchapter G, Chapter 659].
4648 (f-2) [(3)] A single electronic funds transfer may contain
4749 payments to multiple payees. Individual transfers or warrants are
4850 not required for each payee.
4951 [(4) The comptroller may also use the electronic funds
5052 transfer system to deposit a portion of an employee's gross pay into
5153 an account of an eligible state employee organization for a
5254 membership as prescribed by Subchapter G, Chapter 659.]
5355 SECTION 2. This Act takes effect immediately if it receives
5456 a vote of two-thirds of all the members elected to each house, as
5557 provided by Section 39, Article III, Texas Constitution. If this
5658 Act does not receive the vote necessary for immediate effect, this
5759 Act takes effect September 1, 2019.
