59 relating to the creation of the Brickston Municipal Utility
610 District; granting a limited power of eminent domain; providing
711 authority to issue bonds; providing authority to impose
812 assessments, fees, and taxes.
913 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1014 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1115 Code, is amended by adding Chapter 8038 to read as follows:
1216 CHAPTER 8038. BRICKSTON MUNICIPAL UTILITY DISTRICT
1317 SUBCHAPTER A. GENERAL PROVISIONS
1418 Sec. 8038.0101. DEFINITIONS. In this chapter:
1519 (1) "Board" means the district's board of directors.
1620 (2) "Commission" means the Texas Commission on
1721 Environmental Quality.
1822 (3) "Director" means a board member.
1923 (4) "District" means the Brickston Municipal Utility
2024 District.
2125 Sec. 8038.0102. NATURE OF DISTRICT. The district is a
2226 municipal utility district created under Section 59, Article XVI,
2327 Texas Constitution.
2428 Sec. 8038.0103. CONFIRMATION AND DIRECTOR ELECTION
2529 REQUIRED. The temporary directors shall hold an election to
2630 confirm the creation of the district and to elect five permanent
2731 directors as provided by Section 49.102, Water Code.
2832 Sec. 8038.0104. CONSENT OF MUNICIPALITY REQUIRED. The
2933 temporary directors may not hold an election under Section
3034 8038.0103 until each municipality in whose corporate limits or
3135 extraterritorial jurisdiction the district is located has
3236 consented by ordinance or resolution to the creation of the
3337 district and to the inclusion of land in the district.
3438 Sec. 8038.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3539 (a) The district is created to serve a public purpose and benefit.
3640 (b) The district is created to accomplish the purposes of:
3741 (1) a municipal utility district as provided by
3842 general law and Section 59, Article XVI, Texas Constitution; and
3943 (2) Section 52, Article III, Texas Constitution, that
4044 relate to the construction, acquisition, improvement, operation,
4145 or maintenance of macadamized, graveled, or paved roads, or
4246 improvements, including storm drainage, in aid of those roads.
4347 Sec. 8038.0106. INITIAL DISTRICT TERRITORY. (a) The
4448 district is initially composed of the territory described by
4549 Section 2 of the Act enacting this chapter.
4650 (b) The boundaries and field notes contained in Section 2 of
4751 the Act enacting this chapter form a closure. A mistake made in the
4852 field notes or in copying the field notes in the legislative process
4953 does not affect the district's:
5054 (1) organization, existence, or validity;
5155 (2) right to issue any type of bond for the purposes
5256 for which the district is created or to pay the principal of and
5357 interest on a bond;
5458 (3) right to impose a tax; or
5559 (4) legality or operation.
5660 SUBCHAPTER B. BOARD OF DIRECTORS
5761 Sec. 8038.0201. GOVERNING BODY; TERMS. (a) The district
5862 is governed by a board of five elected directors.
5963 (b) Except as provided by Section 8038.0202, directors
6064 serve staggered four-year terms.
6165 Sec. 8038.0202. TEMPORARY DIRECTORS. (a) On or after the
6266 effective date of the Act enacting this chapter, the owner or owners
6367 of a majority of the assessed value of the real property in the
6468 district may submit a petition to the commission requesting that
6569 the commission appoint as temporary directors the five persons
6670 named in the petition. The commission shall appoint as temporary
6771 directors the five persons named in the petition.
6872 (b) Temporary directors serve until the earlier of:
6973 (1) the date permanent directors are elected under
7074 Section 8038.0103; or
7175 (2) the fourth anniversary of the effective date of
7276 the Act enacting this chapter.
7377 (c) If permanent directors have not been elected under
7478 Section 8038.0103 and the terms of the temporary directors have
7579 expired, successor temporary directors shall be appointed or
7680 reappointed as provided by Subsection (d) to serve terms that
7781 expire on the earlier of:
7882 (1) the date permanent directors are elected under
7983 Section 8038.0103; or
8084 (2) the fourth anniversary of the date of the
8185 appointment or reappointment.
8286 (d) If Subsection (c) applies, the owner or owners of a
8387 majority of the assessed value of the real property in the district
8488 may submit a petition to the commission requesting that the
8589 commission appoint as successor temporary directors the five
8690 persons named in the petition. The commission shall appoint as
8791 successor temporary directors the five persons named in the
8892 petition.
8993 SUBCHAPTER C. POWERS AND DUTIES
9094 Sec. 8038.0301. GENERAL POWERS AND DUTIES. The district
9195 has the powers and duties necessary to accomplish the purposes for
9296 which the district is created.
9397 Sec. 8038.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
9498 DUTIES. The district has the powers and duties provided by the
9599 general law of this state, including Chapters 49 and 54, Water Code,
96100 applicable to municipal utility districts created under Section 59,
97101 Article XVI, Texas Constitution.
98102 Sec. 8038.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
99103 52, Article III, Texas Constitution, the district may design,
100104 acquire, construct, finance, issue bonds for, improve, operate,
101105 maintain, and convey to this state, a county, or a municipality for
102106 operation and maintenance macadamized, graveled, or paved roads, or
103107 improvements, including storm drainage, in aid of those roads.
104108 Sec. 8038.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
105109 road project must meet all applicable construction standards,
106110 zoning and subdivision requirements, and regulations of each
107111 municipality in whose corporate limits the road project is located.
108112 (b) If a road project is not located in the corporate limits
109113 of a municipality, the road project must meet all applicable
110114 construction standards, subdivision requirements, and regulations
111115 of each county in which the road project is located.
112116 (c) If the state will maintain and operate the road, the
113117 Texas Transportation Commission must approve the plans and
114118 specifications of the road project.
115119 Sec. 8038.0305. COMPLIANCE WITH MUNICIPAL CONSENT
116120 ORDINANCE OR RESOLUTION. The district shall comply with all
117121 applicable requirements of any ordinance or resolution that is
118122 adopted under Section 54.016 or 54.0165, Water Code, and that
119123 consents to the creation of the district or to the inclusion of land
120124 in the district.
121125 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
122126 Sec. 8038.0401. ELECTIONS REGARDING TAXES OR BONDS.
123127 (a) The district may issue, without an election, bonds and other
124128 obligations secured by:
125129 (1) revenue other than ad valorem taxes; or
126130 (2) contract payments described by Section 8038.0403.
127131 (b) The district must hold an election in the manner
128132 provided by Chapters 49 and 54, Water Code, to obtain voter approval
129133 before the district may impose an ad valorem tax or issue bonds
130134 payable from ad valorem taxes.
131135 (c) The district may not issue bonds payable from ad valorem
132136 taxes to finance a road project unless the issuance is approved by a
133137 vote of a two-thirds majority of the district voters voting at an
134138 election held for that purpose.
135139 Sec. 8038.0402. OPERATION AND MAINTENANCE TAX. (a) If
136140 authorized at an election held under Section 8038.0401, the
137141 district may impose an operation and maintenance tax on taxable
138142 property in the district in accordance with Section 49.107, Water
139143 Code.
140144 (b) The board shall determine the tax rate. The rate may not
141145 exceed the rate approved at the election.
142146 Sec. 8038.0403. CONTRACT TAXES. (a) In accordance with
143147 Section 49.108, Water Code, the district may impose a tax other than
144148 an operation and maintenance tax and use the revenue derived from
145149 the tax to make payments under a contract after the provisions of
146150 the contract have been approved by a majority of the district voters
147151 voting at an election held for that purpose.
148152 (b) A contract approved by the district voters may contain a
149153 provision stating that the contract may be modified or amended by
150154 the board without further voter approval.
151155 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
152156 Sec. 8038.0501. AUTHORITY TO ISSUE BONDS AND OTHER
153157 OBLIGATIONS. The district may issue bonds or other obligations
154158 payable wholly or partly from ad valorem taxes, impact fees,
155159 revenue, contract payments, grants, or other district money, or any
156160 combination of those sources, to pay for any authorized district
157161 purpose.
158162 Sec. 8038.0502. TAXES FOR BONDS. At the time the district
159163 issues bonds payable wholly or partly from ad valorem taxes, the
160164 board shall provide for the annual imposition of a continuing
161165 direct ad valorem tax, without limit as to rate or amount, while all
162166 or part of the bonds are outstanding as required and in the manner
163167 provided by Sections 54.601 and 54.602, Water Code.
164168 Sec. 8038.0503. BONDS FOR ROAD PROJECTS. At the time of
165169 issuance, the total principal amount of bonds or other obligations
166170 issued or incurred to finance road projects and payable from ad
167171 valorem taxes may not exceed one-fourth of the assessed value of the
168172 real property in the district.
169173 SECTION 2. The Brickston Municipal Utility District
170174 initially includes all the territory contained in the following
171175 area:
172176 BEING A 448.8-ACRE [19,551,571 SQUARE FEET] MUD TRACT OUT OF
173177 THE WILLIAM HINES SURVEY NUMBER 53, ABSTRACT NUMBER 346, TRAVIS
174178 COUNTY, TEXAS, SAID TRACT BEING ALL OF THAT CALLED 127.535-ACRE
175179 TRACT DESCRIBED TO TEXAS BRIDLE TRAILS, LLC., AS RECORDED IN
176180 DOCUMENT NUMBER 2008035687 OF THE OFFICIAL PUBLIC RECORDS OF TRAVIS
177181 COUNTY, TEXAS [O.P.R.T.C.T.], AND A PORTION OF THAT CALLED
178182 315.26-ACRE TRACT DESCRIBED TO TEXAS BRIDLE TRAILS, LLC. AS
179183 RECORDED IN DOCUMENT NUMBER 2008035688 O.P.R.T.C.T. SAID TRACT
180184 BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
181185 BEGINNING at a 5/8-inch iron rod found in the west line of
182186 that called 29.556-acre tract described to Centex Land, LTD. as
183187 recorded in Document Number 1999124374 O.P.R.T.C.T. for the south
184188 corner of that called 9.35-acre tract described to Johnny Wilkins,
185189 Jr. and wife, Virgina C. Wilkins as recorded in Volume 12363, Page

314318 said POINT OF BEGINNING of the tract described herein, and
315319 containing 448.8 Acres [19,551,571 Square Feet].
316320 SECTION 3. (a) The legal notice of the intention to
317321 introduce this Act, setting forth the general substance of this
318322 Act, has been published as provided by law, and the notice and a
319323 copy of this Act have been furnished to all persons, agencies,
320324 officials, or entities to which they are required to be furnished
321325 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
322326 Government Code.
323327 (b) The governor, one of the required recipients, has
324328 submitted the notice and Act to the Texas Commission on
325329 Environmental Quality.
326330 (c) The Texas Commission on Environmental Quality has filed
327331 its recommendations relating to this Act with the governor, the
328332 lieutenant governor, and the speaker of the house of
329333 representatives within the required time.
330334 (d) All requirements of the constitution and laws of this
331335 state and the rules and procedures of the legislature with respect
332336 to the notice, introduction, and passage of this Act are fulfilled
333337 and accomplished.
334338 SECTION 4. (a) If this Act does not receive a two-thirds
335339 vote of all the members elected to each house, Subchapter C, Chapter
336340 8038, Special District Local Laws Code, as added by Section 1 of
337341 this Act, is amended by adding Section 8038.0306 to read as follows:
338342 Sec. 8038.0306. NO EMINENT DOMAIN POWER. The district may
339343 not exercise the power of eminent domain.
340344 (b) This section is not intended to be an expression of a
341345 legislative interpretation of the requirements of Section 17(c),
342346 Article I, Texas Constitution.
343347 SECTION 5. This Act takes effect immediately if it receives
344348 a vote of two-thirds of all the members elected to each house, as
345349 provided by Section 39, Article III, Texas Constitution. If this
346350 Act does not receive the vote necessary for immediate effect, this
347351 Act takes effect September 1, 2019.
