46 AN ACT
57 relating to the enforcement of commercial motor vehicle safety
68 standards in certain municipalities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 644.101(b), Transportation Code, as
911 amended by Chapters 138 (H.B. 1355), 142 (H.B. 1570), and 324 (S.B.
1012 1488), Acts of the 85th Legislature, Regular Session, 2017, is
1113 reenacted and amended to read as follows:
1214 (b) A police officer of any of the following municipalities
1315 is eligible to apply for certification under this section:
1416 (1) a municipality with a population of 50,000 or
1517 more;
1618 (2) a municipality with a population of 25,000 or more
1719 any part of which is located in a county with a population of
1820 500,000 or more;
1921 (3) a municipality with a population of less than
2022 25,000:
2123 (A) any part of which is located in a county with
2224 a population of 3.3 million; and
2325 (B) that contains or is adjacent to an
2426 international port;
2527 (4) a municipality with a population of at least
2628 34,000 that is located in a county that borders two or more states;
2729 (5) a municipality any part of which is located in a
2830 county bordering the United Mexican States;
2931 (6) a municipality with a population of less than
3032 5,000 that is located:
3133 (A) adjacent to a bay connected to the Gulf of
3234 Mexico; and
3335 (B) in a county adjacent to a county with a
3436 population greater than 3.3 million;
3537 (7) a municipality that is located:
3638 (A) within 25 miles of an international port; and
3739 (B) in a county that does not contain a highway
3840 that is part of the national system of interstate and defense
3941 highways and is adjacent to a county with a population greater than
4042 3.3 million;
4143 (8) a municipality with a population of less than
4244 8,500 that:
4345 (A) is the county seat; and
4446 (B) contains a highway that is part of the
4547 national system of interstate and defense highways;
4648 (9) a municipality located in a county with a
4749 population between 60,000 and 66,000 adjacent to a bay connected to
4850 the Gulf of Mexico;
4951 (10) a municipality with a population of more than
5052 40,000 and less than 50,000 that is located in a county with a
5153 population of more than 285,000 and less than 300,000 that borders
5254 the Gulf of Mexico; [or]
5355 (11) a municipality with a population between 18,000
5456 and 18,500 that is located entirely in a county that:
5557 (A) has a population of less than 200,000;
5658 (B) is adjacent to two counties that each have a
5759 population of more than 1.2 million; and
5860 (C) contains two highways that are part of the
5961 national system of interstate and defense highways;
6062 (12) [(11)] a municipality with a population of more
6163 than 3,000 and less than 10,000 that:
6264 (A) contains a highway that is part of the
6365 national system of interstate and defense highways; and
6466 (B) is located in a county with a population
6567 between 150,000 and 155,000; or
6668 (13) a municipality with a population of less than
6769 75,000 that is located in three counties, at least one of which has
6870 a population greater than 3.3 million.
6971 SECTION 2. To the extent of any conflict, this Act prevails
7072 over another Act of the 86th Legislature, Regular Session, 2019,
7173 relating to nonsubstantive additions to and corrections in enacted
7274 codes.
7375 SECTION 3. This Act takes effect September 1, 2019.
