46 AN ACT
57 relating to making permanent the former temporary increases in
68 records archive fees and records management and preservation fees
79 charged by district and county clerks.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 51.305(b), Government Code, as effective
1012 September 1, 2019, is amended to read as follows:
1113 (b) The commissioners court of a county may adopt a district
1214 court records archive fee of not more than $10 [$5] for the filing
1315 of a suit, including an appeal from an inferior court, or a
1416 cross-action, counterclaim, intervention, contempt action, motion
1517 for new trial, or third-party petition, in any court in the county
1618 for which the district clerk accepts filings as part of the county's
1719 annual budget. The fee must be set and itemized in the county's
1820 budget as part of the budget preparation process and must be
1921 approved in a public meeting. The fee is for preservation and
2022 restoration services performed in connection with maintaining a
2123 district court records archive.
2224 SECTION 2. Section 51.317(b), Government Code, as effective
2325 September 1, 2019, is amended to read as follows:
2426 (b) The fees are:
2527 (1) except as provided by Subsection (b-1), for filing
2628 a suit, including an appeal from an inferior court, $50;
2729 (2) for filing a cross-action, counterclaim,
2830 intervention, contempt action, motion for new trial, or third-party
2931 petition, $15;
3032 (3) for issuing a citation or other writ or process not
3133 otherwise provided for, including one copy, when requested at the
3234 time a suit or action is filed, $8;
3335 (4) for records management and preservation, $10; and
3436 (5) in addition to the other fees imposed under this
3537 section, for filing a suit, including an appeal from an inferior
3638 court, or a cross-action, counterclaim, intervention, contempt
3739 action, motion for new trial, or third-party petition, the amount
3840 adopted by the county commissioners court, not to exceed $10 [$5],
3941 for court records archiving.
4042 SECTION 3. Section 101.0611, Government Code, as effective
4143 September 1, 2019, is amended to read as follows:
4244 Sec. 101.0611. DISTRICT COURT FEES AND COSTS: GOVERNMENT
4345 CODE. The clerk of a district court shall collect fees and costs
4446 under the Government Code as follows:
4547 (1) appellate judicial system filing fees for:
