46 AN ACT
57 relating to strategic fiscal reviews of state agencies and
68 programs.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Chapter 322, Government Code, is amended by
911 adding Section 322.0175 to read as follows:
1012 Sec. 322.0175. STRATEGIC FISCAL REVIEW OF STATE AGENCIES
1113 AND PROGRAMS. (a) The board shall perform a strategic fiscal
1214 review for each state agency currently the subject of Sunset
1315 Advisory Commission review under Chapter 325 (Texas Sunset Act).
14- The board shall not perform a review under this section of state
15- agencies listed in Section 325.025(b), Government Code, because
16- these agencies are not subject to the legislative appropriations
17- process.
1816 (b) The board shall prepare and submit a report of the
1917 findings of the strategic fiscal review by September 1 of the
2018 even-numbered year of the biennium during which the review is
2119 conducted to the governor, lieutenant governor, and speaker of the
2220 house of representatives and to the members of the senate finance
2321 and house appropriations committees.
2422 (c) The strategic fiscal review report must contain:
2523 (1) a description of the discrete activities the state
2624 agency is charged with conducting or performing together with:
2725 (A) a justification for each activity by
2826 reference to a statute or other legal authority; and
2927 (B) an evaluation of the effectiveness and
3028 efficiency of the state agency's policies, management, fiscal
3129 affairs, and operations in relation to each activity;
3230 (2) for each activity identified under Subdivision
3331 (1):
3432 (A) a quantitative estimate of any adverse
3533 effects that reasonably may be expected to result if the activity
3634 were discontinued, together with a description of the methods by
3735 which the adverse effects were estimated;
3836 (B) an itemized account of expenditures required
3937 to maintain the activity at the minimum level of service or
4038 performance required by the statute or other legal authority,
4139 together with a concise statement of the quantity and quality of
4240 service or performance required at that minimum level; and
4341 (C) an itemized account of expenditures required
4442 to maintain the activity at the current level of service or
4543 performance, together with a concise statement of the quantity and
4644 quality of service or performance provided at that current level;
4745 (3) a ranking of activities identified under
4846 Subdivision (1) that illustrates the relative importance of each
4947 activity to the overall goals and purposes of the state agency at
5048 current service or performance levels; and
5149 (4) recommendations to the legislature regarding
5250 whether the legislature should continue funding each activity
5351 identified under Subdivision (1) and, if so, at what level.
5452 (d) The legislature may consider the strategic fiscal
5553 review reports in connection with the legislative appropriations
5654 process.
5755 (e) Until the board has completed a strategic fiscal review
5856 under this section, all information, documentary or otherwise,
5957 prepared or maintained in conducting the strategic fiscal review or
6058 preparing the strategic fiscal review report, including
6159 intra-agency and interagency communications and drafts of the
6260 strategic fiscal review report, or portions of those drafts, is
6361 excepted from required public disclosure as audit working papers
6462 under Section 552.116. This subsection does not affect whether
6563 information described by this subsection is confidential or
6664 excepted from required public disclosure under a law other than
6765 Section 552.116.
6866 SECTION 2. This Act takes effect immediately if it receives
6967 a vote of two-thirds of all the members elected to each house, as
7068 provided by Section 39, Article III, Texas Constitution. If this
7169 Act does not receive the vote necessary for immediate effect, this
7270 Act takes effect September 1, 2019.
