| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Sections 382.05155(d), (e), and (f), Health and |
|---|
| 9 | 11 | | Safety Code, are amended to read as follows: |
|---|
| 10 | 12 | | (d) The commission by rule may add a surcharge to an |
|---|
| 11 | 13 | | application fee assessed under this chapter for an expedited |
|---|
| 12 | 14 | | application in an amount sufficient to cover the expenses incurred |
|---|
| 13 | 15 | | by the expediting, including overtime, costs of full-time |
|---|
| 14 | 16 | | equivalent commission employees to support the expedited |
|---|
| 15 | 17 | | processing of air permit applications, contract labor, and other |
|---|
| 16 | 18 | | costs. Money from the surcharge collected under this section may be |
|---|
| 17 | 19 | | used to support the expedited processing of air permit applications |
|---|
| 18 | 20 | | under this section. |
|---|
| 19 | 21 | | (e) The commission may authorize the use of overtime, |
|---|
| 20 | 22 | | full-time equivalent commission employees to support the expedited |
|---|
| 21 | 23 | | processing of air permit applications, or contract labor to process |
|---|
| 22 | 24 | | expedited applications. The overtime, full-time equivalent |
|---|
| 23 | 25 | | commission employees, or contract labor authorized under this |
|---|
| 24 | 26 | | section is not included in the calculation of the number of |
|---|
| 25 | 27 | | full-time equivalent commission employees allotted under other |
|---|
| 26 | 28 | | law. |
|---|
| 27 | 29 | | (f) The commission may pay for compensatory time, overtime, |
|---|
| 28 | 30 | | full-time equivalent commission employees supporting the expedited |
|---|
| 29 | 31 | | processing of air permit applications, or contract labor used to |
|---|
| 30 | 32 | | implement this section. The commission is authorized to set the |
|---|
| 31 | 33 | | rate for overtime compensation for full-time equivalent commission |
|---|
| 32 | 34 | | employees supporting the expedited processing of air permit |
|---|
| 33 | 35 | | applications. |

| 34 | 36 | | SECTION 2. This Act takes effect September 1, 2019. |
