46 AN ACT
57 relating to the expedited processing of certain applications for
68 permits under the Texas Clean Air Act.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Sections 382.05155(d), (e), and (f), Health and
911 Safety Code, are amended to read as follows:
1012 (d) The commission by rule may add a surcharge to an
1113 application fee assessed under this chapter for an expedited
1214 application in an amount sufficient to cover the expenses incurred
1315 by the expediting, including overtime, costs of full-time
1416 equivalent commission employees to support the expedited
1517 processing of air permit applications, contract labor, and other
1618 costs. Money from the surcharge collected under this section may be
1719 used to support the expedited processing of air permit applications
1820 under this section.
1921 (e) The commission may authorize the use of overtime,
2022 full-time equivalent commission employees to support the expedited
2123 processing of air permit applications, or contract labor to process
2224 expedited applications. The overtime, full-time equivalent
2325 commission employees, or contract labor authorized under this
2426 section is not included in the calculation of the number of
2527 full-time equivalent commission employees allotted under other
2628 law.
2729 (f) The commission may pay for compensatory time, overtime,
2830 full-time equivalent commission employees supporting the expedited
2931 processing of air permit applications, or contract labor used to
3032 implement this section. The commission is authorized to set the
3133 rate for overtime compensation for full-time equivalent commission
3234 employees supporting the expedited processing of air permit
3335 applications.
3436 SECTION 2. This Act takes effect September 1, 2019.
