5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the authorization of a fee for participation in the
68 Managed Lands Deer Program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 11.032(b), Parks and Wildlife Code, is
911 amended to read as follows:
1012 (b) The department shall deposit to the credit of the game,
1113 fish, and water safety account all revenue, less allowable costs,
1214 from the following sources:
1315 (1) all types of fishing licenses and stamps and
1416 shrimping licenses;
1517 (2) all types of hunting licenses and stamps;
1618 (3) trapping licenses and other licenses relating to
1719 the taking, propagation, and sale of fur-bearing animals or their
1820 pelts;
1921 (4) sale of marl, sand, gravel, shell, and mudshell;
2022 (5) oyster bed rentals and permits;
2123 (6) federal funds received for fish and wildlife
2224 research, management, development and conservation, resource
2325 protection, and law enforcement, unless the funds are received for
2426 the specific purposes of Subchapter F, Chapter 77;
2527 (7) sale of property, less advertising costs,
2628 purchased from this account or a special fund or account that is now
2729 part of this account;
2830 (8) fines and penalties collected for violations of a
2931 law pertaining to the protection and conservation of wild birds,
3032 wild fowl, wild animals, fish, shrimp, oysters, game birds and
3133 animals, fur-bearing animals, alligators, and any other wildlife
3234 resources of this state;
3335 (9) sale of rough fish by the department;
3436 (10) fees for importation permits;
3537 (11) fees from supplying fish for or placing fish in
3638 water located on private property;
3739 (12) sale of seized pelts;
3840 (13) sale or lease of grazing rights to and the
3941 products from game preserves, sanctuaries, and management areas;
4042 (14) contracts for the removal of fur-bearing animals
4143 and reptiles from wildlife management areas;
4244 (15) vessel registration fees;
4345 (16) vessel manufacturer or dealer licensing fees;
4446 (17) fines or penalties imposed by a court for
4547 violation of water safety laws contained in Chapter 31 of this code;
4648 (18) alligator hunter's or alligator buyer's licenses;
4749 (19) sale of alligators or any part of an alligator by
4850 the department;
4951 (20) fees and revenue collected under Section
5052 11.027(b) or (c) of this code that are associated with the
5153 conservation of fish and wildlife;
5254 (21) any other source provided by law; [and]
5355 (22) vessel and outboard motor titling fees; and
5456 (23) participation fees collected under Section
5557 43.976.
5658 SECTION 2. Chapter 43, Parks and Wildlife Code, is amended
5759 by adding Subchapter Y to read as follows:
5860 SUBCHAPTER Y. MANAGED LANDS DEER PROGRAM
5961 Sec. 43.975. DEFINITION. In this subchapter, "program"
6062 means the Managed Lands Deer Program described by 31 T.A.C. Section
6163 65.29, or a successor to that program.
6264 Sec. 43.976. PROGRAM PARTICIPATION FEE. (a) The
6365 commission by rule may impose a fee for participation in the
6466 program. Section 2001.0045, Government Code, does not apply to a
6567 rule adopted under this section.
6668 (b) The commission shall remit a fee collected under
6769 Subsection (a) to the comptroller for deposit to the credit of the
6870 game, fish, and water safety account.
6971 Sec. 43.977. RULES. The commission shall adopt rules
7072 required to implement the program.
7173 SECTION 3. This Act takes effect immediately if it receives
7274 a vote of two-thirds of all the members elected to each house, as
7375 provided by Section 39, Article III, Texas Constitution. If this
7476 Act does not receive the vote necessary for immediate effect, this
7577 Act takes effect September 1, 2019.
