| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 11.032(b), Parks and Wildlife Code, is |

| 9 | 11 | | amended to read as follows: |

| 10 | 12 | | (b) The department shall deposit to the credit of the game, |
|---|
| 11 | 13 | | fish, and water safety account all revenue, less allowable costs, |
|---|
| 12 | 14 | | from the following sources: |
|---|
| 13 | 15 | | (1) all types of fishing licenses and stamps and |
|---|
| 14 | 16 | | shrimping licenses; |
|---|
| 15 | 17 | | (2) all types of hunting licenses and stamps; |
|---|
| 16 | 18 | | (3) trapping licenses and other licenses relating to |
|---|
| 17 | 19 | | the taking, propagation, and sale of fur-bearing animals or their |
|---|
| 18 | 20 | | pelts; |
|---|
| 19 | 21 | | (4) sale of marl, sand, gravel, shell, and mudshell; |
|---|
| 20 | 22 | | (5) oyster bed rentals and permits; |
|---|
| 21 | 23 | | (6) federal funds received for fish and wildlife |
|---|
| 22 | 24 | | research, management, development and conservation, resource |
|---|
| 23 | 25 | | protection, and law enforcement, unless the funds are received for |
|---|
| 24 | 26 | | the specific purposes of Subchapter F, Chapter 77; |
|---|
| 25 | 27 | | (7) sale of property, less advertising costs, |
|---|
| 26 | 28 | | purchased from this account or a special fund or account that is now |
|---|
| 27 | 29 | | part of this account; |
|---|
| 28 | 30 | | (8) fines and penalties collected for violations of a |
|---|
| 29 | 31 | | law pertaining to the protection and conservation of wild birds, |
|---|
| 30 | 32 | | wild fowl, wild animals, fish, shrimp, oysters, game birds and |
|---|
| 31 | 33 | | animals, fur-bearing animals, alligators, and any other wildlife |
|---|
| 32 | 34 | | resources of this state; |
|---|
| 33 | 35 | | (9) sale of rough fish by the department; |
|---|
| 34 | 36 | | (10) fees for importation permits; |
|---|
| 35 | 37 | | (11) fees from supplying fish for or placing fish in |
|---|
| 36 | 38 | | water located on private property; |
|---|
| 37 | 39 | | (12) sale of seized pelts; |

| 38 | 40 | | (13) sale or lease of grazing rights to and the |

| 39 | 41 | | products from game preserves, sanctuaries, and management areas; |

| 40 | 42 | | (14) contracts for the removal of fur-bearing animals |

| 41 | 43 | | and reptiles from wildlife management areas; |
|---|
| 42 | 44 | | (15) vessel registration fees; |

| 43 | 45 | | (16) vessel manufacturer or dealer licensing fees; |

| 44 | 46 | | (17) fines or penalties imposed by a court for |
|---|
| 45 | 47 | | violation of water safety laws contained in Chapter 31 of this code; |

| 46 | 48 | | (18) alligator hunter's or alligator buyer's licenses; |
|---|
| 47 | 49 | | (19) sale of alligators or any part of an alligator by |
|---|
| 48 | 50 | | the department; |
|---|
| 49 | 51 | | (20) fees and revenue collected under Section |

| 50 | 52 | | 11.027(b) or (c) of this code that are associated with the |

| 51 | 53 | | conservation of fish and wildlife; |

| 54 | 56 | | (23) participation fees collected under Section |

| 55 | 57 | | 43.976. |

| 56 | 58 | | SECTION 2. Chapter 43, Parks and Wildlife Code, is amended |
|---|
| 57 | 59 | | by adding Subchapter Y to read as follows: |

| 58 | 60 | | SUBCHAPTER Y. MANAGED LANDS DEER PROGRAM |
|---|
| 59 | 61 | | Sec. 43.975. DEFINITION. In this subchapter, "program" |
|---|
| 60 | 62 | | means the Managed Lands Deer Program described by 31 T.A.C. Section |
|---|
| 61 | 63 | | 65.29, or a successor to that program. |
|---|
| 62 | 64 | | Sec. 43.976. PROGRAM PARTICIPATION FEE. (a) The |
|---|
| 63 | 65 | | commission by rule may impose a fee for participation in the |
|---|
| 64 | 66 | | program. Section 2001.0045, Government Code, does not apply to a |
|---|
| 65 | 67 | | rule adopted under this section. |
|---|
| 66 | 68 | | (b) The commission shall remit a fee collected under |
|---|
| 67 | 69 | | Subsection (a) to the comptroller for deposit to the credit of the |
|---|
| 68 | 70 | | game, fish, and water safety account. |
|---|
| 69 | 71 | | Sec. 43.977. RULES. The commission shall adopt rules |
|---|
| 70 | 72 | | required to implement the program. |
|---|
| 71 | 73 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 72 | 74 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 73 | 75 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 74 | 76 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 75 | 77 | | Act takes effect September 1, 2019. |
