6 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 9 | | SECTION 1. Title 3, Agriculture Code, is amended by adding |
---|
8 | 10 | | Chapter 50D to read as follows: |
---|
9 | 11 | | CHAPTER 50D. TEXAS OLIVE OIL INDUSTRY ADVISORY BOARD |
---|
10 | 12 | | Sec. 50D.001. DEFINITION. In this chapter, "board" means |
---|
11 | 13 | | the Texas Olive Oil Industry Advisory Board. |
---|
12 | 14 | | Sec. 50D.002. BOARD. (a) The board is composed of the |
---|
13 | 15 | | following nine members appointed by the commissioner: |
---|
14 | 16 | | (1) five members who are olive growers, one of whom |
---|
15 | 17 | | represents each of the five established olive-growing regions of |
---|
16 | 18 | | the state as determined by the commissioner; |
---|
17 | 19 | | (2) one representative of infrastructure who is |
---|
18 | 20 | | engaged in harvesting, milling, or agritourism; |
---|
19 | 21 | | (3) one researcher or educator who is employed by an |
---|
20 | 22 | | institution of higher education, as defined by Section 61.003, |
---|
21 | 23 | | Education Code; |
---|
22 | 24 | | (4) one representative from the Texas A&M AgriLife |
---|
23 | 25 | | Extension Service; and |
---|
24 | 26 | | (5) one representative from the department. |
---|
25 | 27 | | (b) The board shall elect a presiding officer from among its |
---|
26 | 28 | | members. |
---|
27 | 29 | | (c) Members of the board serve staggered six-year terms, |
---|
28 | 30 | | with the terms of three members expiring on February 1 of each |
---|
29 | 31 | | odd-numbered year. Members may be reappointed at the end of a term. |
---|
30 | 32 | | (d) Chapter 2110, Government Code, does not apply to the |
---|
31 | 33 | | size, composition, or duration of the board. |
---|
32 | 34 | | (e) Service on the board by a state officer or employee is an |
---|
33 | 35 | | additional duty of the member's office or employment. Members of |
---|
34 | 36 | | the board are not entitled to compensation or reimbursement of |
---|
35 | 37 | | expenses. |
---|
36 | 38 | | (f) The board may accept gifts and grants from any source to |
---|
37 | 39 | | be used to carry out a function of the board. |
---|
38 | 40 | | Sec. 50D.003. DUTIES. The board shall: |
---|
39 | 41 | | (1) assist the department in: |
---|
40 | 42 | | (A) assessing the state of the olive and olive |
---|
41 | 43 | | oil industry in this state; |
---|
42 | 44 | | (B) developing recommendations to the |
---|
43 | 45 | | commissioner and the legislature to promote and expand the olive |
---|
44 | 46 | | and olive oil industry in this state; |
---|
45 | 47 | | (C) identifying and obtaining grants and gifts to |
---|
46 | 48 | | promote and expand the olive and olive oil industry in this state; |
---|
47 | 49 | | and |
---|
48 | 50 | | (D) developing a long-term vision and marketable |
---|
49 | 51 | | identity for the olive and olive oil industry in this state that |
---|
50 | 52 | | take into consideration future industry development, funding, |
---|
51 | 53 | | research, educational programming, risk management, and marketing; |
---|
52 | 54 | | and |
---|
53 | 55 | | (2) review and provide guidance on rules impacting the |
---|
54 | 56 | | olive and olive oil industry in this state. |
---|
55 | 57 | | Sec. 50D.004. MEETINGS. The board shall meet twice each |
---|
56 | 58 | | year and may meet at other times considered necessary by the |
---|
57 | 59 | | commissioner. |
---|
58 | 60 | | Sec. 50D.005. STAFF. The board is administratively |
---|
59 | 61 | | attached to the department. The department shall provide the board |
---|
60 | 62 | | with the staff necessary to carry out the board's duties under this |
---|
61 | 63 | | chapter. |
---|
62 | 64 | | SECTION 2. As soon as practicable after the effective date |
---|
63 | 65 | | of this Act, the commissioner of agriculture shall appoint the |
---|
64 | 66 | | members of the Texas Olive Oil Industry Advisory Board as provided |
---|
65 | 67 | | by Chapter 50D, Agriculture Code, as added by this Act. |
---|
66 | 68 | | SECTION 3. This Act takes effect immediately if it receives |
---|
67 | 69 | | a vote of two-thirds of all the members elected to each house, as |
---|
68 | 70 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
69 | 71 | | Act does not receive the vote necessary for immediate effect, this |
---|
70 | 72 | | Act takes effect September 1, 2019. |
---|
