57 relating to the Texas Olive Oil Industry Advisory Board.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Title 3, Agriculture Code, is amended by adding
810 Chapter 50D to read as follows:
911 CHAPTER 50D. TEXAS OLIVE OIL INDUSTRY ADVISORY BOARD
1012 Sec. 50D.001. DEFINITION. In this chapter, "board" means
1113 the Texas Olive Oil Industry Advisory Board.
1214 Sec. 50D.002. BOARD. (a) The board is composed of the
1315 following nine members appointed by the commissioner:
1416 (1) five members who are olive growers, one of whom
1517 represents each of the five established olive-growing regions of
1618 the state as determined by the commissioner;
1719 (2) one representative of infrastructure who is
1820 engaged in harvesting, milling, or agritourism;
1921 (3) one researcher or educator who is employed by an
2022 institution of higher education, as defined by Section 61.003,
2123 Education Code;
2224 (4) one representative from the Texas A&M AgriLife
2325 Extension Service; and
2426 (5) one representative from the department.
2527 (b) The board shall elect a presiding officer from among its
2628 members.
2729 (c) Members of the board serve staggered six-year terms,
2830 with the terms of three members expiring on February 1 of each
2931 odd-numbered year. Members may be reappointed at the end of a term.
3032 (d) Chapter 2110, Government Code, does not apply to the
3133 size, composition, or duration of the board.
3234 (e) Service on the board by a state officer or employee is an
3335 additional duty of the member's office or employment. Members of
3436 the board are not entitled to compensation or reimbursement of
3537 expenses.
3638 (f) The board may accept gifts and grants from any source to
3739 be used to carry out a function of the board.
3840 Sec. 50D.003. DUTIES. The board shall:
3941 (1) assist the department in:
4042 (A) assessing the state of the olive and olive
4143 oil industry in this state;
4244 (B) developing recommendations to the
4345 commissioner and the legislature to promote and expand the olive
4446 and olive oil industry in this state;
4547 (C) identifying and obtaining grants and gifts to
4648 promote and expand the olive and olive oil industry in this state;
4749 and
4850 (D) developing a long-term vision and marketable
4951 identity for the olive and olive oil industry in this state that
5052 take into consideration future industry development, funding,
5153 research, educational programming, risk management, and marketing;
5254 and
5355 (2) review and provide guidance on rules impacting the
5456 olive and olive oil industry in this state.
5557 Sec. 50D.004. MEETINGS. The board shall meet twice each
5658 year and may meet at other times considered necessary by the
5759 commissioner.
5860 Sec. 50D.005. STAFF. The board is administratively
5961 attached to the department. The department shall provide the board
6062 with the staff necessary to carry out the board's duties under this
6163 chapter.
6264 SECTION 2. As soon as practicable after the effective date
6365 of this Act, the commissioner of agriculture shall appoint the
6466 members of the Texas Olive Oil Industry Advisory Board as provided
6567 by Chapter 50D, Agriculture Code, as added by this Act.
6668 SECTION 3. This Act takes effect immediately if it receives
6769 a vote of two-thirds of all the members elected to each house, as
6870 provided by Section 39, Article III, Texas Constitution. If this
6971 Act does not receive the vote necessary for immediate effect, this
7072 Act takes effect September 1, 2019.
