77 relating to license renewal applications for certain family
88 residential centers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.0505 to read as follows:
1212 Sec. 42.0505. DENIAL OF CERTAIN APPLICATIONS FOR LICENSE
1313 RENEWAL. (a) This section applies only to a child-care facility
1414 licensed under this chapter that is a family residential center:
1515 (1) operated by or under a contract with United States
1616 Immigration and Customs Enforcement to enforce federal immigration
1717 laws;
1818 (2) in which each child at the center is detained with
1919 a parent or other adult family member who remains at the center; and
2020 (3) in which a parent or family member of a child
2121 provides the direct care for the child except for specific
2222 circumstances when the child is cared for directly by the center or
2323 another adult in the custody of the center.
2424 (b) The commission may deny an application for renewal of a
2525 family residential center license if the license holder is under
2626 investigation by a state agency of another state in the United
2727 States.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2019.
