 A BILL TO BE ENTITLED
 AN ACT
 relating to license renewal applications for certain family
 residential centers.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 42, Human Resources Code,
 is amended by adding Section 42.0505 to read as follows:
 Sec. 42.0505.  DENIAL OF CERTAIN APPLICATIONS FOR LICENSE
 RENEWAL. (a) This section applies only to a child-care facility
 licensed under this chapter that is a family residential center:
 (1)  operated by or under a contract with United States
 Immigration and Customs Enforcement to enforce federal immigration
 laws;
 (2)  in which each child at the center is detained with
 a parent or other adult family member who remains at the center; and
 (3)  in which a parent or family member of a child
 provides the direct care for the child except for specific
 circumstances when the child is cared for directly by the center or
 another adult in the custody of the center.
 (b)  The commission may deny an application for renewal of a
 family residential center license if the license holder is under
 investigation by a state agency of another state in the United
 States.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2019.
