| 7 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 13 | | SECTION 1. Subchapter H, Chapter 49, Water Code, is amended |
|---|
| 9 | 14 | | by adding Section 49.239 to read as follows: |
|---|
| 10 | 15 | | Sec. 49.239. RESERVOIR NAME APPROVAL. (a) Before a |
|---|
| 11 | 16 | | district may name a reservoir that the district is authorized to |
|---|
| 12 | 17 | | construct and that the district will own or operate, the district |
|---|
| 13 | 18 | | must request approval of the name from the commissioners court of |
|---|
| 14 | 19 | | the county in which the reservoir project site is located. |
|---|
| 15 | 20 | | (b) If the reservoir project site is located in more than |
|---|
| 16 | 21 | | one county, the district must request approval of the name from the |
|---|
| 17 | 22 | | commissioners court of the county in which the reservoir project |
|---|
| 18 | 23 | | site is principally located. For purposes of this subsection, a |
|---|
| 19 | 24 | | reservoir project site is principally located in a county if a |
|---|
| 20 | 25 | | majority of the acreage of the reservoir surface area will be |
|---|
| 21 | 26 | | located in that county. |
|---|
| 22 | 27 | | (c) A commissioners court that receives a request from a |
|---|
| 23 | 28 | | district for the approval of a name for a reservoir under this |
|---|
| 24 | 29 | | section shall approve or deny the request not later than the 60th |
|---|
| 25 | 30 | | day after the date the district submits the request. If the |
|---|
| 26 | 31 | | commissioners court fails to approve or deny the request within the |
|---|
| 27 | 32 | | period prescribed by this subsection, the request is considered |
|---|
| 28 | 33 | | approved. |
|---|
| 29 | 34 | | (d) This section does not prevent a district from soliciting |
|---|
| 30 | 35 | | input regarding a name for a reservoir from the commissioners court |
|---|
| 31 | 36 | | of each county in which the reservoir or any part of the reservoir |
|---|
| 32 | 37 | | will be located. |
|---|
| 33 | 38 | | SECTION 2. Section 49.239, Water Code, as added by this Act, |
|---|
| 34 | 39 | | applies to a reservoir project that was authorized to be |
|---|
| 35 | 40 | | constructed before the effective date of this Act but that is not |
|---|
| 36 | 41 | | complete on the effective date of this Act and a reservoir project |
|---|
| 37 | 42 | | that is authorized to be constructed on or after the effective date |
|---|
| 38 | 43 | | of this Act. |

| 39 | 44 | | SECTION 3. This Act takes effect September 1, 2019. |
