108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 801.260, Occupations Code, is amended to
1210 read as follows:
13- Sec. 801.260. REQUIREMENTS TO PERFORM [LICENSE REQUIRED
14- FOR] EQUINE DENTISTRY. A person may not perform equine dentistry
15- or offer or attempt to act as an equine dental provider unless the
16- person is:
11+ Sec. 801.260. LICENSE REQUIRED FOR EQUINE DENTISTRY. A
12+ person may not perform equine dentistry or offer or attempt to act
13+ as an equine dental provider unless the person is:
1714 (1) a veterinarian who is active and in good standing;
1815 [or]
1916 (2) a licensed equine dental provider who is active
2017 and in good standing performing under the supervision of a
2118 veterinarian who is active and in good standing; or
2219 (3) a student of an equine dental provider
2320 certification program approved by the board who:
2421 (A) is completing the practical requirements of
2522 the certification program; and
2623 (B) performs equine dentistry under the direct
2724 supervision of a veterinarian who is active and in good standing.
28- SECTION 2. Section 801.261(a), Occupations Code, is amended
29- to read as follows:
30- (a) The board shall issue an equine dental provider license
31- to a person who is qualified under this section. A person is
32- qualified to be licensed as an equine dental provider if the person:
33- (1) passes a jurisprudence examination conducted by
34- the board in accordance with Section 801.264;
35- (2) is not disqualified under this chapter or board
36- rule; and
37- (3) is certified by a [the International Association
38- of Equine Dentistry or another] board-approved certification
39- entity or organization.
40- SECTION 3. (a) Section 801.261(a), Occupations Code, as
41- amended by this Act, applies only to an application for an equine
42- dental provider license submitted on or after September 1, 2020. An
43- application submitted before that date is governed by the law in
44- effect immediately before the effective date of this Act, and the
45- former law is continued in effect for that purpose.
46- (b) The change in law made by this Act to Section
47- 801.261(a), Occupations Code, does not apply to the renewal of a
48- license issued before September 1, 2020.
49- SECTION 4. This Act takes effect September 1, 2019.
