49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the name of the Southwest Collegiate Institute for the
712 Deaf.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Chapter 131, Education Code, is amended to read
1015 as follows:
1116 CHAPTER 131. SOUTHWEST COLLEGE [COLLEGIATE INSTITUTE] FOR THE DEAF
1217 Sec. 131.001. SOUTHWEST COLLEGE [COLLEGIATE INSTITUTE] FOR
1318 THE DEAF. The Southwest College [Collegiate Institute] for the
1419 Deaf is a postsecondary educational institution providing
1520 instruction for hearing-impaired students preparing for a career or
1621 for enrollment in a senior college or university.
1722 Sec. 131.002. ADMINISTRATION. (a) The college
1823 [institute] is under the direct control and management of the board
1924 of trustees of the Howard Junior College District.
2025 (b) The college [institute] and its programs shall be
2126 administered by personnel who are trained and qualified to work
2227 with hearing-impaired students and are fluent in manual
2328 communication skills.
2429 Sec. 131.003. LOCATION. The college [institute] is located
2530 on land deeded to the governing board by the federal Department of
2631 Education for the purpose of operating the college [institute].
2732 The governing board may not conduct regular junior college programs
2833 for students with unimpaired hearing on the college [institute]
2934 campus except as an integral part of the program offered to
3035 hearing-impaired students when:
3136 (1) it is educationally appropriate to enroll hearing
3237 students in classes for the hearing-impaired; or
3338 (2) special programs are needed to train hearing and
3439 hearing-impaired persons to become professional service providers
3540 for the deaf.
3641 Sec. 131.004. COURSES, PROGRAMS, AND SERVICES. (a) The
3742 college [institute] shall offer, but is not limited to offering,
3843 the following courses, programs, and services for hearing-impaired
3944 post-secondary students:
4045 (1) learning development services, including academic
4146 counseling, tutorial services, reading instruction, services to
4247 counter learning disabilities, and library-related services;
4348 (2) communications services, including interpreters
4449 for academic and nonacademic functions, speech therapy, and
4550 auditory evaluation and training;
4651 (3) academic college preparatory courses;
4752 (4) career analysis services designed to assist each
4853 student in identifying a career interest, considering the student's
4954 aptitudes, abilities, and skills;
5055 (5) regular college courses, including vocational and
5156 technical education and liberal arts courses;
5257 (6) extracurricular activities, including intramural
5358 athletics; and
5459 (7) postgraduation services, including job placement
5560 services and services designed to orient employers to
5661 hearing-impaired workers.
5762 (b) The course work offered by the college [institute] shall
5863 emphasize self-contained classrooms with instruction conducted by
5964 instructors who are trained and qualified to work with
6065 hearing-impaired students and are fluent in manual communication
6166 skills. Hearing-impaired students may enroll in integrated classes
6267 that are regular classes offered to students with unimpaired
6368 hearing enrolled in the junior college.
6469 (c) The programs, services, and facilities of the college
6570 [institute] shall be designed to be appropriate to the needs of
6671 hearing-impaired students.
6772 (d) The executive director shall determine which courses
6873 offered by the college [institute] are appropriate for an
6974 electronic display on a screen or terminal, with less than 30
7075 seconds delay, of a speaker's spoken message. The college
7176 [institute] shall implement the electronic display in those
7277 courses.
7378 Sec. 131.005. TUITION. (a) A Texas resident student
7479 enrolled in the college [institute] is exempt from tuition fees
7580 under Section 54.364.
7681 (b) A student who is not a resident of Texas shall pay
7782 tuition at a rate that is the lesser of:
7883 (1) the rate provided by this code for a nonresident
7984 student enrolled at a general academic teaching institution; or
8085 (2) a rate determined by the board of trustees and the
8186 Texas Higher Education Coordinating Board[, Texas College and
8287 University System] to be the approximate cost to the college
8388 [institute], not including room and board, of educating a student
8489 during the academic year beginning the next fall.
8590 Sec. 131.006. APPROPRIATIONS; GRANTS. (a) The governing
8691 board of the college [institute] may receive appropriations for the
8792 college's [institute's] operations only if the board operates the
8893 college [institute] in compliance with this chapter.
8994 (b) The board may accept gifts, grants, or donations of
9095 money or property given to the college [institute] for the
9196 college's [institute's] exclusive use in carrying out the purposes
9297 of this subchapter.
9398 (c) The board may expend appropriated funds for maintenance
9499 and operation, including the maintenance and operation of student
95100 housing and food service, unless the funds are specifically
96101 restricted to another purpose by the appropriation.
97102 SECTION 2. Section 51.911(a)(1), Education Code, is amended
98103 to read as follows:
99104 (1) "Institution of higher education" has the meaning
100105 assigned by [Subdivision (7) of] Section 61.003 of this code, but
101106 includes the Southwest College [Collegiate Institute] for the Deaf
102107 and Texas State Technical College System [Institute].
103108 SECTION 3. Section 51.925(b), Education Code, is amended to
104109 read as follows:
105110 (b) In this section, "institution of higher education" has
106111 the meaning assigned by [Subdivision (7) of] Section 61.003 of this
107112 code, except that the term includes the Southwest College
108113 [Collegiate Institute] for the Deaf and Texas State Technical
109114 College System [Institute].
110115 SECTION 4. Section 54.364(a)(5), Education Code, is amended
111116 to read as follows:
112117 (5) "Institution of higher education" has the meaning
113118 assigned by Section 61.003, except that the term includes the
114119 Southwest College [Collegiate Institute] for the Deaf.
115120 SECTION 5. Section 31.001(8), Natural Resources Code, is
116121 amended to read as follows:
117122 (8) "Institution of higher education" means the Texas
118123 State Technical College System, the Southwest College [Collegiate
119124 Institute] for the Deaf, or an institution of higher education,
120125 excluding a public junior college, as defined by Section 61.003,
121126 Education Code.
122127 SECTION 6. (a) The name of the Southwest Collegiate
123128 Institute for the Deaf is changed to the Southwest College for the
124129 Deaf.
125130 (b) A reference in law to the Southwest Collegiate Institute
126131 for the Deaf means the Southwest College for the Deaf.
127132 (c) An appropriation for the use or benefit of the Southwest
128133 Collegiate Institute for the Deaf is available for the use and
129134 benefit of the Southwest College for the Deaf.
130135 SECTION 7. This Act takes effect September 1, 2019.
