76 relating to withdrawals of water from the Edwards Aquifer to supply

98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. The heading to Section 1.33, Chapter 626, Acts of
1110 the 73rd Legislature, Regular Session, 1993, is amended to read as
1211 follows:
1312 Sec. 1.33. WELL METERING AND PERMITTING EXEMPTIONS
1413 [EXEMPTION].
1514 SECTION 2. Section 1.33, Chapter 626, Acts of the 73rd
1615 Legislature, Regular Session, 1993, is amended by adding
1716 Subsections (e), (f), and (g) to read as follows:
1817 (e) In addition to permitted withdrawals from the aquifer, a
1918 municipally owned utility owned by the City of San Antonio, without
2019 a permit, may withdraw groundwater from the aquifer if:
2120 (1) the utility uses the groundwater to supply a
2221 military installation with water for human consumption,
2322 irrigation, operations, mission support, or infrastructure
2423 maintenance; and
2524 (2) the utility and the military installation enter
2625 into a contract requiring the installation to reduce its
2726 groundwater withdrawals from the aquifer by the same amount of
2827 withdrawn water the installation receives from the utility.
2928 (f) Subsection (e) of this section does not alter the
3029 obligations of a military installation under a biological opinion
3130 issued by a federal agency.
3231 (g) The amount of water provided by a municipally owned
3332 utility to a military installation under Subsection (e) of this
3433 section may not exceed the maximum amount of water that the military
3534 installation is authorized to withdraw from the aquifer under a
3635 biological opinion issued by a federal agency.
3736 SECTION 3. This Act takes effect September 1, 2019.
