4	6		AN ACT
5	7		relating to the requirement that the comptroller of public accounts
6	8		receive copies of orders adopted in connection with the
7	9		administration of elections.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 12.032(b), Election Code, is amended to
10	12		read as follows:
11	13		(b) The county clerk shall deliver a certified copy of the
12	14		order to the secretary of state [and comptroller of public
13	15		accounts] not later than the third day after the date the order is
14	16		adopted.
15	17		SECTION 2. Section 12.034(b), Election Code, is amended to
16	18		read as follows:
17	19		(b) Not later than the third day after the date the
18	20		rescission order is adopted, the county clerk shall deliver a
19	21		certified copy of the order to the secretary of state [and
20	22		comptroller of public accounts].
21	23		SECTION 3. Section 31.031(d), Election Code, is amended to
22	24		read as follows:
23	25		(d) Not later than the third day after the date the order is
24	26		adopted, the county clerk shall deliver a certified copy of the
25	27		order to:
26	28		(1) the secretary of state; and
27	29		(2) [the comptroller of public accounts; and
28	30		[(3)] each member of the county election commission.
29	31		SECTION 4. Section 31.048(c), Election Code, is amended to
30	32		read as follows:
31	33		(c) Not later than the third day after the date an order
32	34		abolishing the position of administrator is adopted, the county
33	35		clerk shall deliver a certified copy of the order to the secretary
34	36		of state [and comptroller of public accounts].
35	37		SECTION 5. Section 31.071(c), Election Code, is amended to
36	38		read as follows:
37	39		(c) Not later than the third day after the date the order is
38	40		adopted, the county clerk shall deliver a certified copy of the
39	41		order to the secretary of state [and comptroller of public
40	42		accounts].
41	43		SECTION 6. Section 31.076(b), Election Code, is amended to
42	44		read as follows:
43	45		(b) Not later than the third day after the date the
44	46		rescission order is adopted, the county clerk shall deliver a
45	47		certified copy of the order to the secretary of state [and
46	48		comptroller of public accounts].
47	49		SECTION 7. Section 31.152(h), Election Code, is amended to
48	50		read as follows:
49	51		(h) Not later than the third day after the date the order is
50	52		adopted, the chair of the joint elections commission shall deliver
51	53		a certified copy of the order to:
52	54		(1) the secretary of state;
53	55		(2) [the comptroller;
54	56		[(3)] each member of the county election commission, if
55	57		any; and
56	58		(3) [(4)] a representative from each participating
57	59		entity.
58	60		SECTION 8. Section 31.170(c), Election Code, is amended to
59	61		read as follows:
60	62		(c) Not later than the third day after the date an order
61	63		abolishing the position of joint elections administrator is
62	64		adopted, the county clerk of the most populous participating county
63	65		shall deliver a certified copy of the order to the secretary of
64	66		state [and comptroller].
65	67		SECTION 9. The changes in law made by this Act apply only to
66	68		an order adopted on or after the effective date of this Act. An
67	69		order adopted before the effective date of this Act is governed by
68	70		the law in effect on the date the order was adopted, and the former
69	71		law is continued in effect for that purpose.
70	72		SECTION 10. This Act takes effect September 1, 2019.
